AMENDMENT TO HOUSE BILL 3955 




2    AMENDMENT NO. ______. Amend House Bill 3955 by replacing 
3everything after the enacting clause with the following:

 
 
4    "Section 5. The University of Illinois Hospital Act is 
5amended  by adding Section 8h as follows:
 
6    (110 ILCS 330/8h new)
7    Sec. 8h. Emergency room treatment; delay of treatment 
8prohibition. Notwithstanding any provision of law to the 
9contrary, the University of Illinois Hospital, in accordance 
10with Section 1395dd(a) and 1395dd(b) of the Social Security 
11Act, shall not delay provisions of a required appropriate 
12medical screening examination or further medical examination 
13and treatment for a patient in a University of Illinois 
14Hospital emergency room in order to inquire about the 
15individual's method of payment or insurance status.

1    Section 10. The Hospital Licensing Act is amended  by 
2adding Section 6.34 as follows:
 
3    (210 ILCS 85/6.34 new)
4    Sec. 6.34. Emergency room treatment; delay of treatment 
5prohibition. Notwithstanding any provision of law to the 
6contrary, a hospital licensed under this Act, in accordance 
7with Section 1395dd(a) and 1395dd(b) of the Social Security 
8Act, shall not delay provisions of a required appropriate 
9medical screening examination or further medical examination 
10and treatment for a patient in a hospital's emergency room in 
11order to inquire about the individual's method of payment or 
12insurance status.".
