AMENDMENT TO HOUSE BILL 4118

2    AMENDMENT NO. ______. Amend House Bill 4118 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Public Utilities Act is amended by adding
5Section 8-206.5 as follows:
 
6    (220 ILCS 5/8-206.5 new)
7    Sec. 8-206.5. Disconnection Protection Program.
8    (a) No later than June 1, 2024, each electric and gas
9utility serving more than 500,000 customers in this State
10shall implement a Disconnection Protection Program, whereby
11customers who have applied for assistance through the Low
12Income Home Energy Assistance Program (LIHEAP), Percentage of
13Income Payment Plan (PIPP), or other energy assistance
14programs, including, but not limited to, those programs
15established under the Energy Assistance Act, shall be
16temporarily protected from disconnection for 60 days after the

1utility receives notice from a local administrative agency
2that the customer has submitted an application to LIHEAP,
3PIPP, or other energy assistance program.
4    (b) As part of its Disconnection Protection Program, each
5electric and gas utility shall utilize all available customer
6data, including, but not limited to, household-level income
7and energy burden, the census tract ability-to-pay index, and
8the census tract poverty ratio, to determine whether a
9customer may be eligible for energy assistance programs. The
10utility must provide customers it has determined to be
11eligible for energy assistance programs with specific
12information on how to obtain energy assistance. The utility
13shall conduct the customer outreach described in this
14subsection on a monthly basis.
15    (c) Each electric and gas utility may recover costs for
16implementation, administration, and ongoing operation of its
17Disconnection Protection Program through the utility's revenue
18requirement, subject to a review for prudence and
19reasonableness by the Commission.
 
20    Section 99. Effective date. This Act takes effect upon
21becoming law.".
