SYNOPSIS AS INTRODUCED:

625 ILCS 5/11-1433 new

Amends the Illinois Vehicle Code. Requires a contractor or person employed to deliver goods from a store or restaurant through a third-party delivery service to use a non-carbon emitting mode of transportation while making such deliveries. Provides that a contractor or person who fails to comply with the provisions may be subject to a fine of $250 or suspension of the contractor's or person's driving privileges. Restricts the provisions to counties with a population of 3,000,000 or more. Limits the concurrent exercise of home rule powers.

A BILL FOR

AN ACT concerning transportation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Vehicle Code is amended by adding Section 11-1433 as follows:

(625 ILCS 5/11-1433 new)

Sec. 11-1433. Third-party delivery service; zero-emission deliveries.

(a) As used in this Section, "third-party delivery service" has the meaning given to that term under the Fair Food and Retail Delivery Act.

(b) A contractor or person employed to deliver goods from a store or restaurant through a third-party delivery service shall use a non-carbon emitting mode of transportation while making such deliveries.

(c) A contractor or person that violates this Section may be subject to a fine of $250 or suspension of the contractor's or person's driver's license.

(d) This Section shall only apply to counties with a population of 3,000,000 or more.

(e) A home rule municipality may not regulate deliveries pertaining to third-party delivery services in a manner inconsistent with this Section. This Section is a limitation under subsection (i) of Section 6 of Article VII of the Illinois Constitution on the concurrent exercise by home rule units of powers and functions exercised by the State.
