AMENDMENT TO HOUSE BILL 4445

2    AMENDMENT NO. ______. Amend House Bill 4445 by replacing 
3everything after the enacting clause with the following: 
 
4    "Section 5. The Victims' Economic Security and Safety Act 
5is amended by adding Section 33 as follows:
 
6    (820 ILCS 180/33 new)
7    Sec. 33. Employees' personal use of employer-provided 
8electronic devices. An employer shall not take any 
9disciplinary action against an employee, including, but not 
10limited to, counseling, reprimand, suspension, or termination, 
11for using or attempting to use employer-issued equipment to 
12record an act or threat of violence committed against the 
13employee or a family or household member of the employee, nor 
14shall an employer deprive an employee of employer-issued 
15equipment solely because the employee used or attempted to use 
16the equipment to record an act or threat of violence committed

1against the employee or a family or household member of the 
2employee. Nothing in this Section prohibits an employer from 
3complying with an investigation, court order or subpoena for a 
4device, information, data, or documents.
 
5    Section 99. Effective date. This Act takes effect upon 
6becoming law.".
