Requires the Office of the State Fire Marshal to adopt amendments to its permanently moored craft fire prevention and safety rules to provide for waivers, conditional waivers, limits to inspection and examination requirements, and reductions in the frequency of inspections and examinations for deck barges used as permanently moored craft in water that is no deeper than half of the barge's hull depth. Describes criteria that may be considered by the Office when amending its rules. Effective immediately. |

1 | | AN ACT concerning State government. |
2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly: |
4 | | Section 5. The State Fire Marshal Act is amended by adding |
5 | | Section 5 as follows: |
6 | | (20 ILCS 2905/5 new) |
7 | | Sec. 5. Amendments to permanently moored craft fire |
8 | | prevention and safety rules. Notwithstanding any other |
9 | | provision of law, within one year after the effective date of |
10 | | this amendatory Act of the 103rd General Assembly, the Office |
11 | | shall adopt amendments to the permanently moored craft fire |
12 | | prevention and safety rules codified at 41 Ill. Adm. Code Part |
13 | | 149 in order to provide for waivers, conditional waivers, |
14 | | limits to inspection and examination requirements, and |
15 | | reductions in the frequency of inspections and examinations |
16 | | for deck barges used as permanently moored craft in water that |
17 | | is no deeper than half of the barge's hull depth. |
18 | | The amendments adopted by the Office under subsection (a) may |
19 | | provide waivers, limits on inspection and examination |
20 | | requirements, and reductions in the frequency of inspections |
21 | | and examination on the basis of the location, age, condition, |
22 | | size, history, purpose, and occupancy of the deck barge and |
23 | | other factors deemed by the Office as appropriate to consider |
