AMENDMENT TO HOUSE BILL 5135 

2    AMENDMENT NO. ______. Amend House Bill 5135 by replacing 
3everything after the enacting clause with the following:
 
4    "Section 1. This Act may be referred to as the Melanoma 
5Education Law.
 
6    Section 5. The Acupuncture Practice Act is amended by 
7adding Section 41 as follows:
 
8    (225 ILCS 2/41 new)
9    Sec. 41. Abnormal skin growth education.  
10    (a) In addition to any other requirements under this Act, 
11the following applicants must provide proof of completion of a 
12course approved by the Department in abnormal skin growth 
13education, including training on identifying melanoma:
14        (1) An applicant who submits an application for 
15    original licensure on or after January 1, 2026.

1        (2) An applicant who was licensed before January 1, 
2    2026 when submitting the applicant's first application for 
3    renewal or restoration of a license on or after January 1, 
4    2026. 
5    (b) Nothing in this Section shall be construed to create a 
6cause of action or any civil liabilities or to require or 
7permit a licensee or applicant under this Act to practice 
8medicine or otherwise practice outside of the scope of 
9practice of a licensed acupuncturist. 
10    (c) A person licensed under this Act may refer an 
11individual to seek care from a medical professional regarding 
12an abnormal skin growth. Neither a person licensed under this 
13Act who completes abnormal skin growth education as a part of 
14the person's continuing education, nor the person's employer, 
15shall be civilly or criminally liable for acting in good faith 
16or failing to act on information obtained during the course of 
17practicing in the person's profession or employment concerning 
18potential abnormal skin growths. 
 
19    Section 10. The Illinois Athletic Trainers Practice Act is 
20amended by adding Section 9.5 as follows:
 
21    (225 ILCS 5/9.5 new)
22    Sec. 9.5. Abnormal skin growth education. 
23    (a) In addition to any other requirements under this Act, 
24the following applicants must provide proof of completion of a

1course approved by the Department in abnormal skin growth 
2education, including training on identifying melanoma:
3        (1) An applicant who submits an application for 
4    original licensure on or after January 1, 2026.
5        (2) An applicant who was licensed before January 1, 
6    2026 when submitting the applicant's first application for 
7    renewal or restoration of a license on or after January 1, 
8    2026. 
9    (b) Nothing in this Section shall be construed to create a 
10cause of action or any civil liabilities or to require or 
11permit a licensee or applicant under this Act to practice 
12medicine or otherwise practice outside of the scope of 
13practice of a licensed athletic trainer. 
14    (c) A person licensed under this Act may refer an 
15individual to seek care from a medical professional regarding 
16an abnormal skin growth. Neither a person licensed under this 
17Act who completes abnormal skin growth education as a part of 
18the person's continuing education, nor the person's employer, 
19shall be civilly or criminally liable for acting in good faith 
20or failing to act on information obtained during the course of 
21practicing in the person's profession or employment concerning 
22potential abnormal skin growths. 
 
23    Section 15. The Massage Licensing Act is amended by adding 
24Section 68 as follows:

1    (225 ILCS 57/68 new)
2    Sec. 68. Abnormal skin growth education.  
3    (a) In addition to any other requirements under this Act, 
4the following applicants must provide proof of completion of a 
5course approved by the Department in abnormal skin growth 
6education, including training on identifying melanoma:
7        (1) An applicant who submits an application for 
8    original licensure on or after January 1, 2026.
9        (2) An applicant who was licensed before January 1, 
10    2026 when submitting the applicant's first application for 
11    renewal or restoration of a license on or after January 1, 
12    2026. 
13    (b) Nothing in this Section shall be construed to create a 
14cause of action or any civil liabilities or to require or 
15permit a licensee or applicant under this Act to practice 
16medicine or otherwise practice outside of the scope of 
17practice of a licensed massage therapist. 
18    (c) A person licensed under this Act may refer an 
19individual to seek care from a medical professional regarding 
20an abnormal skin growth. Neither a person licensed under this 
21Act who completes abnormal skin growth education as a part of 
22the person's continuing education, nor the person's employer, 
23shall be civilly or criminally liable for acting in good faith 
24or failing to act on information obtained during the course of 
25practicing in the person's profession or employment concerning 
26potential abnormal skin growths.

1    Section 20. The Naprapathic Practice Act is amended by 
2adding Section 66 as follows:
 
3    (225 ILCS 63/66 new)
4    Sec. 66. Abnormal skin growth education.  
5    (a) In addition to any other requirements under this Act, 
6the following applicants must provide proof of completion of a 
7course approved by the Department in abnormal skin growth 
8education, including training on identifying melanoma:
9        (1) An applicant who submits an application for 
10    original licensure on or after January 1, 2026.
11        (2) An applicant who was licensed before January 1, 
12    2026 when submitting the applicant's first application for 
13    renewal or restoration of a license on or after January 1, 
14    2026. 
15    (b) Nothing in this Section shall be construed to create a 
16cause of action or any civil liabilities or to require or 
17permit a licensee or applicant under this Act to practice 
18medicine or otherwise practice outside of the scope of 
19practice of a licensed naprapath. 
20    (c) A person licensed under this Act may refer an 
21individual to seek care from a medical professional regarding 
22an abnormal skin growth. Neither a person licensed under this 
23Act who completes abnormal skin growth education as a part of 
24the person's continuing education, nor the person's employer,

5    Section 25. The Barber, Cosmetology, Esthetics, Hair 
6Braiding, and Nail Technology Act of 1985 is amended by adding 
7Section 1-7.10 as follows:
 
8    (225 ILCS 410/1-7.10 new)
9    Sec. 1-7.10. Abnormal skin growth education.
10    (a) In addition to any other requirements under this Act, 
11the following applicants must provide proof of completion of a 
12course approved by the Department in abnormal skin growth 
13education, including training on identifying melanoma:
14        (1) An applicant who submits an application for 
15    original licensure on or after January 1, 2026.
16        (2) An applicant who was licensed before January 1, 
17    2026 when submitting the applicant's first application for 
18    renewal or restoration of a license on or after January 1, 
19    2026. 
20    (b) Nothing in this Section shall be construed to create a 
21cause of action or any civil liabilities or to require or 
22permit a licensee or applicant under this Act to practice 
23medicine or otherwise practice outside of the scope of 
24practice of a licensed barber, cosmetologist, esthetician,

1hair braider, or nail technician. 
2    (c) A person licensed under this Act may refer an 
3individual to seek care from a medical professional regarding 
4an abnormal skin growth. Neither a person licensed under this 
5Act who completes abnormal skin growth education as a part of 
6the person's continuing education, nor the person's employer, 
7shall be civilly or criminally liable for acting in good faith 
8or failing to act on information obtained during the course of 
9practicing in the person's profession or employment concerning 
10potential abnormal skin growths. 
 
11    Section 35. The Electrologist Licensing Act is amended by 
12adding Section 34 as follows:
 
13    (225 ILCS 412/34 new)
14    Sec. 34. Abnormal skin growth education.  
15    (a) In addition to any other requirements under this Act, 
16the following applicants must provide proof of completion of a 
17course approved by the Department in abnormal skin growth 
18education, including training on identifying melanoma:
19        (1) An applicant who submits an application for 
20    original licensure on or after January 1, 2026.
21        (2) An applicant who was licensed before January 1, 
22    2026 when submitting the applicant's first application for 
23    renewal or restoration of a license on or after January 1, 
24    2026.

1    (b) Nothing in this Section shall be construed to create a 
2cause of action or any civil liabilities or to require or 
3permit a licensee or applicant under this Act to practice

7individual to seek care from a medical professional regarding 
8an abnormal skin growth. Neither a person licensed under this 
9Act who completes abnormal skin growth education as a part of 
10the person's continuing education, nor the person's employer, 
11shall be civilly or criminally liable for acting in good faith 
12or failing to act on information obtained during the course of 
13practicing in the person's profession or employment concerning 
14potential abnormal skin growths. 
 
15    Section 99. Effective date. This Act takes effect upon 
16becoming law.".
