AMENDMENT TO HOUSE BILL 5189 

2    AMENDMENT NO. ______. Amend House Bill 5189 by replacing 
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by adding 
5Section 18c-7402.2 as follows:
 
6    (625 ILCS 5/18c-7402.2 new)
7    Sec. 18c-7402.2. Reports involving railroad fatalities. 
8All reports involving railroad fatalities and all 
9communications between police officers and train crew members 
10involved in those occurrences shall not be public reports and 
11shall be maintained by the police departments and any persons 
12in subsequent possession thereof listed below in a manner that 
13ensures the confidentiality of the train crew's private 
14information. Any reports made public shall have train crew 
15members' private information redacted. However, upon written 
16or electronic mail request, such reports shall be accessible

1at all reasonable times:
2        (1) to the host or employing railroad;
3        (2) by court order, and to others specifically 
4    authorized by court order to obtain the information if the 
5    access is necessary in the performance of their duties; 
6    and
7        (3) to law enforcement officers, State's Attorneys, 
8    Assistant State's Attorneys, and Illinois Commerce 
9    Commission staff if the access is necessary in the 
10    performance of their duties.".
