AMENDMENT TO HOUSE BILL 5244 

2    AMENDMENT NO. ______. Amend House Bill 5244 by replacing 
3everything after the enacting clause with the following:
 
4    "Section 5. The Energy Efficient Building Act is amended 
5by adding Section 16 as follows:
 
6    (20 ILCS 3125/16 new)
7    Sec. 16. Energy requirements.
8    (a) The Board shall adopt rules requiring all buildings to 
9be designed and constructed to provide electric power and 
10either natural gas service or propane service. 
11    (b) A unit of local government may not enact or enforce a 
12resolution, ordinance, rule, code, or policy, or take any 
13other action that restricts or prohibits or has the effect of 
14restricting or prohibiting the type of fuel source or source 
15of energy production that may be used, delivered, converted, 
16or supplied by a natural gas utility or propane provider.

1    (c) A unit of local government, including a home rule 
2unit, may not restrict or prohibit access to a fuel source or 
3to a source of energy production in a manner that is 
4inconsistent with this Section. This Section is a limitation 
5under subsection (i) of Section 6 of Article VII of the 
6Illinois Constitution on the concurrent exercise by home rule 
7units of powers and functions exercised by the State.".
