1 | AN ACT concerning safety. | |||||||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||||||
3 | represented in the General Assembly: | |||||||||||||||||||||||
4 | Section 5. The Electric Vehicle Rebate Act is amended by | |||||||||||||||||||||||
5 | changing Sections 10, 27, and 40 as follows: | |||||||||||||||||||||||
6 | (415 ILCS 120/10) | |||||||||||||||||||||||
7 | Sec. 10. Definitions. As used in this Act: | |||||||||||||||||||||||
8 | "Agency" means the Environmental Protection Agency. | |||||||||||||||||||||||
9 | "Covered Area" means the counties of Cook, DuPage, Kane, | |||||||||||||||||||||||
10 | Lake, McHenry, and Will, the townships of Aux Sable and Goose | |||||||||||||||||||||||
11 | Lake in Grundy County, and the township of Oswego in Kendall | |||||||||||||||||||||||
12 | County. | |||||||||||||||||||||||
13 | "Electric vehicle" means a vehicle that is exclusively | |||||||||||||||||||||||
14 | powered by and refueled by electricity, must be plugged in to | |||||||||||||||||||||||
15 | charge, and is legally permitted licensed to drive on all | |||||||||||||||||||||||
16 | public roadways , including interstate highways . "Electric | |||||||||||||||||||||||
17 | Vehicle" does not include electric mopeds ; , electric | |||||||||||||||||||||||
18 | off-highway vehicles primarily intended to be driven off-road, | |||||||||||||||||||||||
19 | including golf carts; neighborhood electric vehicles; electric | |||||||||||||||||||||||
20 | scooters; electric vehicles with a maximum speed below 45 | |||||||||||||||||||||||
21 | miles per hour; , or hybrid electric vehicles and | |||||||||||||||||||||||
22 | extended-range electric vehicles that are also equipped with | |||||||||||||||||||||||
23 | conventional fueled propulsion or auxiliary engines. |

1 | "Environmental justice community" has the same meaning, | ||||||
2 | based on existing methodologies and findings, used and as may | ||||||
3 | be updated by the Illinois Power Agency and its Program | ||||||
4 | Administrator of the Illinois Solar for All Program. | ||||||
5 | "Low income" means persons and families whose income does | ||||||
6 | not exceed 80% of the State median income for the current State | ||||||
7 | fiscal year, as established by the United States Department of | ||||||
8 | Health and Human Services. | ||||||

11 | Sec. 27. Electric vehicle rebate. | ||||||
12 | (a) From Beginning July 1, 2022 until June 30, 2024 , and | ||||||
13 | continuing as long as funds are available, each person shall | ||||||
14 | be eligible to apply for a rebate, in the amounts set forth | ||||||
15 | below, following the purchase of an electric vehicle in | ||||||
16 | Illinois. From July 1, 2024, and continuing as long as funds | ||||||
17 | are available, each low-income person shall be eligible to | ||||||
18 | apply for a rebate, in the amounts set forth below, following | ||||||
19 | the purchase of an electric vehicle in Illinois. The Agency | ||||||
20 | shall issue rebates consistent with the provisions of this Act | ||||||
21 | and any implementing regulations adopted by the Agency. In no | ||||||
22 | event shall a rebate amount exceed the purchase price of the | ||||||
23 | vehicle. | ||||||
24 | (1) From Beginning July 1, 2022, a $4,000 rebate for | ||||||
25 | the purchase of an electric vehicle that is not an |

1 | electric motorcycle and, from July 1, 2024, a $1,500 | ||||||
2 | rebate for the purchase of an electric vehicle that is an | ||||||
3 | electric motorcycle . | ||||||
4 | (2) From Beginning July 1, 2026, a $2,000 rebate for | ||||||
5 | the purchase of an electric vehicle that is not an | ||||||
6 | electric motorcycle and a $750 rebate for the purchase of | ||||||
7 | an electric vehicle that is an electric motorcycle . | ||||||
8 | (3) From Beginning July 1, 2028, a $1,500 rebate for | ||||||
9 | the purchase of an electric vehicle that is not an | ||||||
10 | electric motorcycle and a $500 rebate for the purchase of | ||||||
11 | an electric vehicle that is an electric motorcycle . | ||||||
12 | (4) (Blank). Beginning July 1, 2022, a $1,500 rebate | ||||||
13 | for the purchase of an electric vehicle that is an | ||||||
14 | electric motorcycle. | ||||||
15 | (b) To be eligible to receive a rebate, a purchaser must: | ||||||
16 | (1) Reside in Illinois, both at the time the vehicle | ||||||
17 | was purchased and at the time the rebate is issued. | ||||||
18 | (2) Purchase an electric vehicle in Illinois on or | ||||||
19 | after July 1, 2022 and be the owner of the vehicle at the | ||||||
20 | time the rebate is issued. Rented or leased vehicles, | ||||||
21 | vehicles purchased from an out-of-state dealership, and | ||||||
22 | vehicles delivered to or received by the purchaser | ||||||
23 | out-of-state are not eligible for a rebate under this Act. | ||||||
24 | (3) If the vehicle is purchased before June 30, 2024, | ||||||
25 | apply Apply for the rebate within 90 days after the | ||||||
26 | vehicle purchase date or, if the vehicle is purchased on |

1 | or after July 1, 2024, apply for the rebate within 120 days | ||||||
2 | after the vehicle purchase date , and provide to the Agency | ||||||
3 | proof of residence, proof of vehicle ownership, and proof | ||||||
4 | that the vehicle was purchased in Illinois, including a | ||||||
5 | copy of a purchase agreement noting an Illinois seller. | ||||||
6 | The purchaser must notify the Agency of any changes in | ||||||
7 | residency or ownership of the vehicle that occur between | ||||||
8 | application for a rebate and issuance of a rebate. | ||||||
9 | (4) From July 1, 2024, apply for the rebate during an | ||||||
10 | open rebate cycle as identified by the Agency. | ||||||
11 | (5) From July 1, 2024, certify that the purchaser | ||||||
12 | qualifies as low-income. | ||||||
13 | (c) The Agency shall make available in application | ||||||
14 | materials methods for purchasers to identify as low-income. | ||||||
15 | The Agency shall prioritize the review of qualified | ||||||
16 | applications from low-income purchasers and award rebates to | ||||||
17 | qualified purchasers accordingly. | ||||||
18 | (d) The purchaser must retain ownership of the vehicle for | ||||||
19 | a minimum of 12 consecutive months immediately after the | ||||||
20 | vehicle purchase date. The purchaser must continue to reside | ||||||
21 | in Illinois during that time frame and register the vehicle in | ||||||
22 | Illinois during that time frame. Rebate recipients who fail to | ||||||
23 | satisfy any of the above criteria will be required to | ||||||
24 | reimburse the Agency all or part of the original rebate amount | ||||||
25 | and shall notify the Agency within 60 days of failing to | ||||||
26 | satisfy the criteria. |

1 | (e) Rebates administered under this Section shall be | ||||||
2 | available for both new and used electric vehicles. | ||||||
3 | (f) A rebate administered under this Act may only be | ||||||
4 | applied for and awarded one time per vehicle identification | ||||||
5 | number. A rebate may only be applied for and awarded once per | ||||||
6 | purchaser in any 10-year period. | ||||||

9 | Sec. 40. Appropriations from the Electric Vehicle Rebate | ||||||
10 | Fund. | ||||||
11 | (a) The Agency shall estimate the amount of user fees | ||||||
12 | expected to be collected under Section 35 of this Act for each | ||||||
13 | fiscal year. User fee funds shall be deposited into and | ||||||
14 | distributed from the Electric Vehicle Rebate Fund in the | ||||||
15 | following manner: | ||||||
16 | (1) Through fiscal year 2023, an An annual amount not | ||||||
17 | to exceed $225,000 may be appropriated to the Agency from | ||||||
18 | the Electric Vehicle Rebate Fund to pay its costs of | ||||||
19 | administering the programs authorized by Section 27 of | ||||||
20 | this Act. Beginning in fiscal year 2024 and in each fiscal | ||||||
21 | year thereafter, an annual amount not to exceed $600,000 | ||||||
22 | may be appropriated to the Agency from the Electric | ||||||
23 | Vehicle Rebate Fund to pay its costs of administering the | ||||||
24 | programs authorized by Section 27 of this Act. An amount | ||||||
25 | not to exceed $225,000 may be appropriated to the |

1 | Secretary of State from the Electric Vehicle Rebate Fund | ||||||
2 | to pay the Secretary of State's costs of administering the | ||||||
3 | programs authorized under this Act. | ||||||
4 | (2) In fiscal year 2022 and each fiscal year | ||||||
5 | thereafter, after appropriation of the amounts authorized | ||||||
6 | by item (1) of subsection (a) of this Section, the | ||||||
7 | remaining moneys estimated to be collected during each | ||||||
8 | fiscal year shall be appropriated. | ||||||
9 | (3) (Blank). | ||||||
10 | (4) Moneys appropriated to fund the programs | ||||||
11 | authorized in Sections 25 and 30 shall be expended only | ||||||
12 | after they have been collected and deposited into the | ||||||
13 | Electric Vehicle Rebate Fund. | ||||||
14 | (b) Amounts appropriated to and deposited into the | ||||||
15 | Electric Vehicle Fund from the General Revenue Fund, or any | ||||||
16 | other fund, General Revenue Fund amounts appropriated to and | ||||||
17 | deposited into the Electric Vehicle Rebate Fund shall be | ||||||
18 | distributed from the Electric Vehicle Rebate Fund to fund the | ||||||
19 | program authorized in Section 27. | ||||||
