SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Climate-Safe Affordable Housing Act. Requires the Department of Natural Resources, in consultation with the Illinois Emergency Management Agency, the Illinois Environmental Protection Agency, the Illinois Housing Development Authority, the Department of Commerce and Economic Opportunity, the United States Department of Housing and Urban Development, the Department of Insurance, the Federal Emergency Management Agency, the Metropolitan Water Reclamation District of Greater Chicago, the Illinois State Water Survey of the University of Illinois, and other State, regional, and local storm water management agencies, thought leaders, and interested parties as the Director of Natural Resources deems appropriate, to submit, to the General Assembly and the Governor, a report that reviews and evaluates the latest available information, research, laws, regulations, policies, procedures, and institutional knowledge concerning climate-safe affordable housing. Details information upon which the recommendations are based. Defines term. Effective immediately.

1    AN ACT concerning housing.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Climate-Safe Affordable Housing Act.
 
6    Section 5. Definitions. In this Act:
7    "Affordable housing" has the meaning given in the Illinois
8Affordable Housing Act.
9    "Climate-safe affordable housing" means affordable housing
10that is:
11        (1) constructed to be resistant to the natural hazards
12    identified in the State natural hazard mitigation plan;
13    and
14        (2) not located in an area zoned as a special flood
15    hazard area, a non-special flood hazard area that is
16    moderate-to-low risk, an area of undetermined flood
17    hazard, or an area that is predicted to be located in one
18    of the aforementioned areas when climate change is
19    considered.
 
20    Section 10. Climate-Safe Affordable Housing Study. By June
2130, 2025, the Department of Natural Resources, in consultation
22with the Illinois Emergency Management Agency, the Illinois

1Environmental Protection Agency, the Illinois Housing
2Development Authority, the Department of Commerce and Economic
3Opportunity, the United States Department of Housing and Urban
4Development, the Department of Insurance, the Federal
5Emergency Management Agency, the Metropolitan Water
6Reclamation District of Greater Chicago, the Illinois State
7Water Survey of the University of Illinois, and other State,
8regional, and local storm water management agencies, thought
9leaders, and interested parties as the Director of Natural
10Resources deems appropriate, shall submit to the General
11Assembly and the Governor, a report that reviews and evaluates
12the latest available information, research, laws, regulations,
13policies, procedures, and institutional knowledge, with
14recommendations based on findings in relation to the
15following:
16        (1) the stock and quality of climate-safe affordable
17    housing, including the amount of affordable housing that
18    is currently located in flood-prone areas and affordable
19    housing that may be located in flood-prone areas when
20    climate change is considered;
21        (2) the prevalence and costs associated with
22    displacement due to flooding events across the State, and
23    the projected trends in frequency and severity of flooding
24    and displacement caused by flooding over the past 2
25    decades, with a focus on low-income households and very
26    low-income households;

1        (3) the apparent impact of global climate change on
2    flooding, with a focus on potential permanent or temporary
3    displacement and climate-safe affordable housing needs
4    caused by flooding;
5        (4) the impacts of State and federal buyouts on the
6    physical, mental, and financial well-being of
7    participants, and their descendants, over the last 5
8    decades;
9        (5) an evaluation of policies that assist or have the
10    potential to assist displaced people recovering from
11    flooding events or participating in pre-disaster
12    mitigation programs, with a focus on low-income households
13    and very low-income households.
14        (6) strategies for improving long-term stability and
15    well-being of people and communities displaced by flooding
16    events or pre-disaster flood mitigation projects, with a
17    focus on strategies that can enhance the physical, mental,
18    and financial well-being of populations that are socially
19    vulnerable or disadvantaged;
20        (7) the coordination and consistency of the criteria,
21    implementation, and accessibility for State funding of
22    climate-safe affordable housing between the Department of
23    Natural Resources, Illinois Emergency Management Agency,
24    Illinois Housing Development Authority, and the Department
25    of Commerce and Economic opportunity.
 
26    Section 99. Effective date. This Act takes effect upon
