| 4 | | "Section 5. The Illinois Highway Code is amended by adding |
| 5 | | Section 5-917.1 as follows:

| 7 | | Sec. 5-917.1. Repeal of road improvement impact fee by |
| 8 | | ordinance or resolution. If DuPage County has adopted and |
| 9 | | implemented a road improvement impact fee by ordinance or |
| 10 | | resolution and repeals the ordinance or resolution, the |
| 11 | | collected fees, along with any accrued interest, in the |
| 12 | | existing impact fee accounts shall be transferred to a |
| 13 | | transportation account to be used for capacity-related |
| 14 | | improvements. Valid impact fee refunds shall be processed in |
| 15 | | accordance with the procedures set forth in the repealed |
| 16 | | ordinance or resolution.". |
