| 2 | | WHEREAS, Subsection (b) of Section 25-10 of the State |
| 3 | | Officials and Employees Ethics Act (5 ILCS 430/25-10) requires |
| 4 | | the Legislative Ethics Commission to diligently search for |
| 5 | | qualified candidates for the Legislative Inspector General |
| 6 | | position and to make recommendations to the General Assembly, |
| 7 | | which shall appoint a Legislative Inspector General by joint |
| 8 | | resolution; and
|
| 9 | | WHEREAS, Subsection (b) of Section 25-10 further states |
| 10 | | that the Legislative Inspector General shall be selected |
| 11 | | solely on the basis of integrity and demonstrated ability and |
| 12 | | sets forth the necessary educational and employment criteria; |
| 13 | | and |
| 14 | | WHEREAS, The Honorable Michael P. McCuskey was appointed |
| 15 | | to serve as Legislative Inspector General on February 23, 2022 |
| 16 | | to complete a 5-year term that expires on June 30, 2023 and has |
| 17 | | communicated to the Legislative Ethics Commission his |
| 18 | | willingness to be reappointed to serve as Legislative |
| 19 | | Inspector General for a 5-year term that begins on July 1, 2023 |
| 20 | | and ends on June 30, 2028; and |
| 21 | | WHEREAS, At its last meeting, the Legislative Ethics |
| 22 | | Commission unanimously voted to recommend that the General |

| 1 | | Assembly retain Judge McCuskey as Legislative Inspector |
| 2 | | General; and |
| 3 | | WHEREAS, Judge McCuskey is an individual of high integrity |
| 4 | | and demonstrated ability who, as a former public defender and |
| 5 | | judge, has led an exemplary career of public service that more |
| 6 | | than qualifies him to continue serving as the Legislative |
| 7 | | Inspector General; and |
| 8 | | WHEREAS, A native of Peoria, Judge McCuskey was admitted |
| 9 | | to the Illinois bar in 1975 and has dedicated his professional |
| 10 | | life to work that has demonstrated his commitment to |
| 11 | | integrity, professionalism, and ethics; and |
| 12 | | WHEREAS, After serving for over a decade as the chief |
| 13 | | public defender in Marshall County, Judge McCuskey was elected |
| 14 | | in 1988 as an Illinois circuit court judge for the Tenth |
| 15 | | Judicial Circuit; and |
| 16 | | WHEREAS, Judge McCuskey was elected to the Illinois |
| 17 | | Appellate Court for the Third Judicial District in 1990, where |
| 18 | | he served until 1998; and |
| 19 | | WHEREAS, Judge McCuskey was nominated for the United |
| 20 | | States District Court for the Central District of Illinois by |
| 21 | | President Bill Clinton and confirmed by a |

| 1 | | Republican-controlled United States Senate in 1998, serving as |
| 2 | | Chief Judge of the District from 2004 to 2012; and |
| 3 | | WHEREAS, Upon retirement from the federal bench in 2014, |
| 4 | | Judge McCuskey was appointed by the Illinois Supreme Court to |
| 5 | | serve again as a State circuit court judge for the Tenth |
| 6 | | Judicial District, a post to which he was subsequently elected |
| 7 | | by voters in 2016; and |
| 8 | | WHEREAS, Judge McCuskey retired from the court in 2020; |
| 9 | | and
|
| 10 | | WHEREAS, Judge McCuskey served on the Illinois Supreme |
| 11 | | Court's Commission on Professionalism for nearly 15 years, |
| 12 | | first as a commissioner and then as an advisor until he |
| 13 | | retired; and
|
| 14 | | WHEREAS, Judge McCuskey currently serves on the Board of |
| 15 | | Directors of the Illinois Judges Association and formerly |
| 16 | | served as Chairman of the Illinois State University Board of |
| 17 | | Trustees; and
|
| 18 | | WHEREAS, Judge McCuskey's extensive experience, |
| 19 | | appointments, and professional activities overwhelmingly |
| 20 | | qualify him for the position of Legislative Inspector General, |
| 21 | | an office that necessitates both keen intellect and insight |
|

| 1 | | into the personal and professional motivations of persons |
| 2 | | acting in the public realm; therefore, be it
|
| 3 | | RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE |
| 4 | | HUNDRED THIRD GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE |
| 5 | | SENATE CONCURRING HEREIN, that we reappoint the Honorable |
| 6 | | Michael P. McCuskey as Legislative Inspector General in |
| 7 | | accordance with subsection (b) of Section 25-10 of the State |
| 8 | | Officials and Employees Ethics Act, endorsing him |
| 9 | | wholeheartedly as surpassing all statutory requirements and |
| 10 | | ensuring that his sterling character and dedication to |
| 11 | | government service will enhance the Office of Legislative |
| 12 | | Inspector General and benefit the administration of the |
| 13 | | ethical foundation on which Illinois legislators and |
| 14 | | legislative employees operate; and be it further
|
| 15 | | RESOLVED, That, in accordance with subsection (b) of |
| 16 | | Section 25-10 of the State Officials and Employees Ethics Act, |
| 17 | | the reappointment of Legislative Inspector General McCuskey |
| 18 | | takes effect upon the adoption of this joint resolution by the |
| 19 | | affirmative vote of three-fifths of the members elected to |
| 20 | | each house of the General Assembly, the certification of this |
| 21 | | joint resolution by the Speaker of the House of |
| 22 | | Representatives and the President of the Senate, and the |
| 23 | | filing of this joint resolution with the Secretary of State; |
| 24 | | and be it further |

| 1 | | RESOLVED, That, in accordance with subsection (b) of |
| 2 | | Section 25-10 of the State Officials and Employees Ethics Act, |
| 3 | | Legislative Inspector General McCuskey's next term as |
| 4 | | Legislative Inspector General shall commence upon July 1, 2023 |
| 5 | | and continue through June 30, 2028; and be it further |
| 6 | | RESOLVED, That copies of this resolution be delivered to |
| 7 | | Legislative Inspector General McCuskey and the Legislative |
| 8 | | Ethics Commission. |
