|
2 | | WHEREAS, Illinois' 1.2 million small business owners, and |
3 | | the 2.5 million small business employees, deserve action from |
4 | | every State agency covered under the Business Assistance and |
5 | | Regulatory Reform Act, 20 ILCS 608, regarding the submission |
6 | | of a statutorily mandated 5-year review of their rules, |
7 | | regulations, and processes on small businesses to the Office |
8 | | of Business Permits and Regulatory Assistance as indicated |
9 | | under 20 ILCS 608/20; and
|
10 | | WHEREAS, The only State agencies to submit a report in |
11 | | 2022 were the Capital Development Board, the Department of |
12 | | Central Management Services, the Department of Commerce and |
13 | | Economic Opportunity, the Department of Employment Security, |
14 | | the Department of Human Rights, the Department of Juvenile |
15 | | Justice, the Department of Transportation, the Department of |
16 | | Revenue, the Governor's Office of Management and Budget, the |
17 | | Human Rights Commission, the Illinois Environmental Protection |
18 | | Agency, the Illinois Lottery, the Illinois Workers' |
19 | | Compensation Commission, and the Office of the Illinois |
20 | | Attorney General; and
|
21 | | WHEREAS, State agencies that did not submit a report in |
22 | | 2022 include the Banking Board of Illinois, the Business |
23 | | Enterprise Council for Minorities, Females, and Persons with |
|

1 | | Disabilities, the Cannabis Commission, the Climate Change |
2 | | Advisory Council, the Commission on Equity and Inclusion, the |
3 | | Elevator Safety Review Board, the Department of Agriculture, |
4 | | the Department of Financial and Professional Regulation, the |
5 | | Department of Innovation and Technology, the Department of |
6 | | Insurance, the Department of Labor, the Department of Natural |
7 | | Resources, the Department of Public Health, the Enterprise |
8 | | Zone Board, the Future of Work Task Force, the Hispanic |
9 | | Employment Plan Advisory Council, the Illinois Finance |
10 | | Authority, the Illinois Gaming Board, the Illinois Institute |
11 | | for Entrepreneurship Education, the Labor Advisory Board, the |
12 | | Labor Relations Board, the Liquor Control Commission, the Main |
13 | | Street Advisory Council, the Pollution Control Board, the |
14 | | Procurement Policy Board, the Property Tax Appeal Board, the |
15 | | Illinois Racing Board, the Illinois State Toll Highway |
16 | | Authority, the Illinois Workforce Innovation Board, the |
17 | | Illinois Works Review Panel, and the Office of Illinois State |
18 | | Treasurer; and

19 | | WHEREAS, These State agencies should have submitted their |
20 | | small business review reports especially after such an |
21 | | unprecedented event as the COVID-19 pandemic; after the |
22 | | pandemic caused the global economy to falter into a recession, |
23 | | leaving millions unemployed, with thousands never to return to |
24 | | the workforce, and supply chains unrecoverable, COVID-19's |
25 | | impact on small businesses across the State could be felt for |

1 | | generations to come; and
|
2 | | WHEREAS, Furthermore, it is disappointing that the |
3 | | Pritzker administration has not publicly admonished its |
4 | | departments for not fulfilling their statutory mandates; the |
5 | | last 5-year report to be completed by every affected |
6 | | department was in 2017; while the COVID-19 pandemic was a |
7 | | hindrance on legislative and State activity in 2020, the most |
8 | | recent 5-year report was due in 2022, which was more than |
9 | | enough time for each department to submit a new report; and
|
10 | | WHEREAS, The effects of government on small business, from |
11 | | the federal government funds through the Coronavirus Aid, |
12 | | Relief, and Economic Security (CARES) Act and the American |
13 | | Rescue Plan Act (ARPA) to the emergency declarations putting |
14 | | curfews on businesses and designating which business were |
15 | | deemed "essential", have all affected State agencies' rules |
16 | | and regulations for small business, leaving the actions of |
17 | | these agencies to be "overtly unreasonable, unduly burdensome, |
18 | | duplicative, or onerous on small businesses" (20 ILCS 608/20 |
19 | | (b)); and
|
20 | | WHEREAS, Now that the pandemic has ended and the economy |
21 | | has normalized, it is time for these State agencies to adhere |
22 | | to the Business Assistance and Regulatory Reform Act and be in |
23 | | accordance with its goal of the review for each State agency, |

1 | | as listed under 20 ILCS 608/20 (b), to recommend changes that |
2 | | will lessen the reporting and paper work requirements on small |
3 | | businesses while still achieving the intent of the underlying |
4 | | statute, to eliminate unnecessary or antiquated permit |
5 | | requirements, to consolidate duplicative or overlapping permit |
6 | | requirements, to simplify overly complex or lengthy |
7 | | application procedures, and to expedite time-consuming agency |
8 | | review and approval procedures; and
|
9 | | WHEREAS, In the Illinois House of Representatives, Rep. |
10 | | Lance Yednock has filed HB 3017, representing progress in the |
11 | | authority promised to the small business community from the |
12 | | State government that "the provisions of this Act shall not |
13 | | lessen or reduce such powers" of State government, but "shall |
14 | | modify the procedures followed in carrying out such powers" |
15 | | extended in the Act to ensure solidified cooperation between |
16 | | small business and State government; therefore, be it
|
17 | | RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE |
18 | | HUNDRED THIRD GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that |
19 | | we implore each of the non-submittal agencies to submit their |
20 | | 5-year small business regulatory review to be in compliance |
21 | | with the Business Assistance and Regulatory Reform Act, 20 |
22 | | ILCS 608; and be it further
