1 | HOUSE RESOLUTION | ||||||
2 | WHEREAS, The National Conference of State Legislatures | ||||||
3 | (NCSL) maintains that the federal government should respect | ||||||
4 | state decisions to regulate cannabis, including hemp in | ||||||
5 | non-FDA approved cannabis products; and | ||||||
6 | WHEREAS, NCSL believes states and localities should be | ||||||
7 | able to set whatever policies work best to improve the public | ||||||
8 | safety, health, and economic development of their communities; | ||||||
9 | and | ||||||
10 | WHEREAS, Federal laws, including the Controlled Substances | ||||||
11 | Act, should be amended to remove cannabis and cannabis | ||||||
12 | derivatives from the Controlled Substance Schedules; and | ||||||
13 | WHEREAS, Federal laws should explicitly allow states to | ||||||
14 | set their own cannabis policies without federal interference; | ||||||
15 | and | ||||||
16 | WHEREAS, In states that have authorized cannabis | ||||||
17 | production, distribution, and possession by establishing an | ||||||
18 | effective regulatory scheme, the federal government should | ||||||
19 | direct federal prosecutors to respect state cannabis laws when | ||||||
20 | exercising discretion around enforcement; and |

1 | WHEREAS, Until cannabis is federally de-scheduled, the | ||||||
2 | federal government should prioritize its enforcement actions | ||||||
3 | against criminal enterprises engaged in illicit cannabis | ||||||
4 | production and sale and not against citizens who are compliant | ||||||
5 | with state cannabis laws; and | ||||||
6 | WHEREAS, Under federal law, cannabis businesses in states | ||||||
7 | that have legalized the sale of cannabis are unable to use the | ||||||
8 | U.S. banking system, forcing them to operate as primarily | ||||||
9 | cash-only entities; and | ||||||
10 | WHEREAS, This reliance on cash makes cannabis businesses | ||||||
11 | prime targets for theft, burglary, armed robbery, and other | ||||||
12 | property crimes; and | ||||||
13 | WHEREAS, If Congress were to pass legislation allowing | ||||||
14 | financial institutions to provide banking services to | ||||||
15 | legitimate state-authorized, cannabis-related businesses, the | ||||||
16 | risk of crime at these businesses would substantially | ||||||
17 | decrease; and | ||||||
18 | WHEREAS, The National Academies of Sciences, Engineering, | ||||||
19 | and Medicine identified challenges and barriers in conducting | ||||||
20 | cannabis research in a 2017 report titled "The Health Effects | ||||||
21 | of Cannabis and Cannabinoids"; and |

1 | WHEREAS, It is especially important that Congress and the | ||||||
2 | federal government provide researchers access to cannabis in | ||||||
3 | the quantity, quality, and type necessary to research the | ||||||
4 | health effects of cannabis use and that adequate funding | ||||||
5 | sources are made available to support cannabis and cannabinoid | ||||||
6 | research that explores the health benefits and risks of | ||||||
7 | cannabis use; therefore, be it | ||||||
8 | RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE | ||||||
9 | HUNDRED THIRD GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that | ||||||
10 | we urge Congress to adopt cannabis banking reform; and be it | ||||||
11 | further | ||||||
12 | RESOLVED, That we urge Congress to remove cannabis from | ||||||
13 | the Controlled Substance Schedules; and be it further | ||||||
14 | RESOLVED, That we urge Congress to reduce barriers to | ||||||
15 | medical research on cannabis and cannabinoids; and be it | ||||||
16 | further | ||||||
17 | RESOLVED, That suitable copies be delivered to the U.S. | ||||||
18 | Senate Majority Leader, the U.S. Senate Minority Leader, the | ||||||
19 | U.S. Speaker of the House, the U.S. House Minority Leader, and | ||||||
20 | all members of the Illinois Congressional Delegation. |
