HOUSE RESOLUTION

 
2    WHEREAS, The National Conference of State Legislatures
3(NCSL) maintains that the federal government should respect
4state decisions to regulate cannabis, including hemp in
5non-FDA approved cannabis products; and
 
6    WHEREAS, NCSL believes states and localities should be
7able to set whatever policies work best to improve the public
8safety, health, and economic development of their communities;
9and
 
10    WHEREAS, Federal laws, including the Controlled Substances
11Act, should be amended to remove cannabis and cannabis
12derivatives from the Controlled Substance Schedules; and
 
13    WHEREAS, Federal laws should explicitly allow states to
14set their own cannabis policies without federal interference;
15and
 
16    WHEREAS, In states that have authorized cannabis
17production, distribution, and possession by establishing an
18effective regulatory scheme, the federal government should
19direct federal prosecutors to respect state cannabis laws when
20exercising discretion around enforcement; and

1    WHEREAS, Until cannabis is federally de-scheduled, the
2federal government should prioritize its enforcement actions
3against criminal enterprises engaged in illicit cannabis
4production and sale and not against citizens who are compliant
5with state cannabis laws; and
 
6    WHEREAS, Under federal law, cannabis businesses in states
7that have legalized the sale of cannabis are unable to use the
8U.S. banking system, forcing them to operate as primarily
9cash-only entities; and
 
10    WHEREAS, This reliance on cash makes cannabis businesses
11prime targets for theft, burglary, armed robbery, and other
12property crimes; and
 
13    WHEREAS, If Congress were to pass legislation allowing
14financial institutions to provide banking services to
15legitimate state-authorized, cannabis-related businesses, the
16risk of crime at these businesses would substantially
17decrease; and
 
18    WHEREAS, The National Academies of Sciences, Engineering,
19and Medicine identified challenges and barriers in conducting
20cannabis research in a 2017 report titled "The Health Effects
21of Cannabis and Cannabinoids"; and

1    WHEREAS, It is especially important that Congress and the
2federal government provide researchers access to cannabis in
3the quantity, quality, and type necessary to research the
4health effects of cannabis use and that adequate funding
5sources are made available to support cannabis and cannabinoid
6research that explores the health benefits and risks of
7cannabis use; therefore, be it
 
8    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE
9HUNDRED THIRD GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
10we urge Congress to adopt cannabis banking reform; and be it
11further
 
12    RESOLVED, That we urge Congress to remove cannabis from
13the Controlled Substance Schedules; and be it further
 
14    RESOLVED, That we urge Congress to reduce barriers to
15medical research on cannabis and cannabinoids; and be it
16further
 
17    RESOLVED, That suitable copies be delivered to the U.S.
18Senate Majority Leader, the U.S. Senate Minority Leader, the
19U.S. Speaker of the House, the U.S. House Minority Leader, and
20all members of the Illinois Congressional Delegation.
