Amends the Conversion and Formation of School Districts Article of the School Code. Within 3 years after the effective date of the amendatory Act, requires elementary school districts to form new school districts but only with other elementary school districts and high school districts to form new school districts but only with other high school districts, notwithstanding any referendum requirements or any other laws to the contrary. Provides that the State Board of Education shall facilitate the creation of the new school districts by providing recommendations on which districts must consolidate. Sets forth the factors that the State Board must take into consideration. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The School Code is amended by adding Section |
5 | | 11E-132 as follows: |
6 | | (105 ILCS 5/11E-132 new) |
7 | | Sec. 11E-132. Elementary and high school district |
8 | | consolidation required. Within 3 years after the effective |
9 | | date of this amendatory Act of the 103rd General Assembly, |
10 | | elementary school districts shall form new school districts |
11 | | but only with other elementary school districts and high |
12 | | school districts shall form new school districts but only with |
13 | | other high school districts, notwithstanding any referendum |
14 | | requirements or any other laws to the contrary. The State |
15 | | Board of Education shall facilitate the creation of the new |
16 | | school districts by providing recommendations on which |
17 | | districts must consolidate. The State Board shall take into |
18 | | consideration the location of the affected districts in |
19 | | relationship to each other, the school needs and conditions of |
20 | | the affected districts and in the area adjacent to those |
21 | | districts, the classification of funds and assets that will |
22 | | result from the consolidation, the best interests of the |
23 | | schools of the affected districts, and the best interests and |
