1 | AN ACT concerning transportation.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 5. The Illinois Vehicle Code is amended by | |||||||||||||||||||
5 | changing Section 11-605 as follows:
| |||||||||||||||||||
6 | (625 ILCS 5/11-605) (from Ch. 95 1/2, par. 11-605)
| |||||||||||||||||||
7 | Sec. 11-605. Special speed limit while passing schools.
| |||||||||||||||||||
8 | (a) For the purpose of this Section, "school" means the | |||||||||||||||||||
9 | following
entities:
| |||||||||||||||||||
10 | (1) A public or private primary or secondary school.
| |||||||||||||||||||
11 | (2) A primary or secondary school operated by a | |||||||||||||||||||
12 | religious institution.
| |||||||||||||||||||
13 | (3) A public, private, or religious nursery school.
| |||||||||||||||||||
14 | On a school day when school children are present and so | |||||||||||||||||||
15 | close
thereto
that a potential hazard exists because of the | |||||||||||||||||||
16 | close proximity of the motorized
traffic , no person shall | |||||||||||||||||||
17 | drive a motor vehicle at a speed in excess of 20 miles
per hour | |||||||||||||||||||
18 | while passing a school zone or while traveling on a local, | |||||||||||||||||||
19 | county, or State roadway on public
school property or upon any | |||||||||||||||||||
20 | public
thoroughfare where children pass going
to and from | |||||||||||||||||||
21 | school.

22 | For the purpose of this Section, a school day begins at | |||||||||||||||||||
23 | 6:30 a.m. and concludes at 5 4 p.m.

1 | This Section shall not be applicable unless appropriate | ||||||
2 | signs are posted
upon streets and highways under their | ||||||
3 | respective jurisdiction and
maintained by the Department, | ||||||
4 | township, county, park district, city,
village or incorporated | ||||||
5 | town wherein the school zone is located. With regard
to the | ||||||
6 | special speed limit while passing schools, such signs
shall | ||||||
7 | give proper due warning that a school zone is being approached | ||||||
8 | and
shall indicate the school zone and the maximum speed limit | ||||||
9 | in effect during
school days when school children are present.

10 | (b) (Blank).
| ||||||
11 | (c) Nothing in this Chapter shall
prohibit the use of | ||||||
12 | electronic speed-detecting devices within 500 feet of
signs | ||||||
13 | within a special school speed zone indicating such zone, as | ||||||
14 | defined
in this Section, nor shall evidence obtained thereby | ||||||
15 | be inadmissible in any
prosecution for speeding provided the | ||||||
16 | use of such device shall apply only
to the enforcement of the | ||||||
17 | speed limit in such special school speed zone.

18 | (d) (Blank).
| ||||||
19 | (e) Except as provided in subsection (e-5), a person who | ||||||
20 | violates this Section is guilty of a petty
offense. Violations | ||||||
21 | of this Section are punishable with a minimum fine
of $150 for | ||||||
22 | the first violation, a minimum fine of $300 for the second or | ||||||
23 | subsequent violation, and community service in an amount | ||||||
24 | determined by the court.

25 | (e-5) A person committing a violation of this Section is | ||||||
26 | guilty of aggravated special speed limit while passing schools |
| |||||||
| |||||||
1 | when he or she drives a motor vehicle at a speed that is: | ||||||
2 | (1) 26 miles per hour or more but less than 35 miles | ||||||
3 | per hour in excess of the applicable special speed limit | ||||||
4 | established under this Section or a similar provision of a | ||||||
5 | local ordinance and is guilty of a Class B misdemeanor; or | ||||||
6 | (2) 35 miles per hour or more in excess of the | ||||||
7 | applicable special speed limit established under this | ||||||
8 | Section or a similar provision of a local ordinance and is | ||||||
9 | guilty of a Class A misdemeanor. | ||||||
