1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois, 
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by 
5changing Sections 3-101, 3-111, and 3-111.1 as follows:
 
6    (625 ILCS 5/3-101)  (from Ch. 95 1/2, par. 3-101)
7    Sec. 3-101. Certificate of title required. 
8    (a) Except as provided in Section 3-102, every owner of a 
9vehicle which is in this State and for which no Illinois 
10certificate of title has been issued by the Secretary of State 
11shall make application to the Secretary of State for an 
12Illinois a certificate of title of the vehicle. Except as 
13provided in Section 3-102, every owner of a vehicle that is in 
14this State for which no Illinois certificate of title has been 
15issued by the Secretary of State and every owner of a vehicle 
16that is in the State applying for a duplicate certificate of 
17title or a corrected certificate of title, including a dealer 
18lien release certificate of title, must make application to 
19the Secretary of State for an Illinois duplicate certificate 
20of title or corrected certificate of title. Any owner of a 
21vehicle in this State with a certificate of title that was 
22issued by an entity other than the Secretary of State and 
23showing an Illinois address for the owner must be converted to

1an Illinois title before the owner can transfer the vehicle.
2    Under no circumstances shall a dealer required to obtain 
3an Illinois certificate of title pursuant to this Code be 
4allowed to obtain an out-of-state certificate of title for 
5purposes of a vehicle held for sale in this State by the 
6dealer. Under no circumstances shall a dealer be allowed to 
7obtain an out-of-state certificate of title in lieu of an 
8Illinois-issued dealer lien release certificate of title when 
9a dealer may have need of such title issuance. Nothing in this 
10Section shall be construed so as to allow a dealer to acquire 
11an out-of-state certificate of title in lieu of acquiring an 
12Illinois certificate of title for purposes of a vehicle held 
13for sale in this State by the dealer. 
14    (b) Every owner of a motorcycle or motor driven cycle 
15purchased new on and after January 1, 1980 shall make 
16application to the Secretary of State for a certificate of 
17title. However, if such cycle is not properly manufactured or 
18equipped for general highway use pursuant to the provisions of 
19this Act, it shall not be eligible for license registration, 
20but shall be issued a distinctive certificate of title except 
21as provided in Sections 3-102 and 3-110 of this Act.
22    (c) The Secretary of State shall not register or renew the 
23registration of a vehicle unless a certificate of title has 
24been issued by the Secretary of State to the owner or an 
25application therefor has been delivered by the owner to the 
26Secretary of State.

1    (d) Every owner of an all-terrain vehicle or off-highway 
2motorcycle purchased on or after January 1, 1998 shall make 
3application to the Secretary of State for a certificate of 
4title.
5    (e) Every owner of a low-speed vehicle manufactured after 
6January 1, 2010 shall make application to the Secretary of 
7State for a certificate of title.

10    Sec. 3-111. Lost, stolen or mutilated certificates. (a) If 
11a certificate of title is lost, stolen, mutilated or destroyed 
12or becomes illegible, the first lienholder or, if none, the 
13owner or legal representative of the owner named in the 
14certificate, as shown by the records of the Secretary of 
15State, shall promptly make application to the Secretary of 
16State for and may obtain a duplicate upon furnishing 
17information satisfactory to the Secretary of State. The 
18duplicate certificate of title shall contain the legend "This 
19is a duplicate certificate and may be subject to the rights of 
20a person under the original certificate." It shall be mailed 
21to the first lienholder named in it or, if none, to the owner 
22or the owner's designee. A certificate of title or a duplicate 
23certificate of title issued by another State showing an 
24Illinois address for the owner cannot be used to transfer 
25ownership of a vehicle.

1    (b) The Secretary of State shall not issue a duplicate 
2certificate of title to any person within 15 days after the 
3issuance of an original certificate of title to such person.
4    (c) A person recovering an original certificate of title 
5for which a duplicate has been issued shall promptly surrender 
6the original certificate to the Secretary of State.
7    (d) An application for a duplicate certificate of title 
8must state the current vehicle odometer reading at the time of 
9application and that the stated odometer reading is one of the 
10following: actual mileage, not the actual mileage or mileage 
11is in excess of its mechanical limits.
12    (e) If a Display certificate of title is lost, stolen, 
13mutilated or destroyed or becomes illegible, the owner or 
14legal representative of the owner named in the original 
15Display certificate of title and in the certificate of title, 
16as shown by the records of the Secretary of State, shall 
17promptly make application for and may obtain a duplicate upon 
18furnishing information satisfactory to the Secretary of State. 
19The duplicate Display certificate of title shall contain the 
20legend "Duplicate Display Certificate of Title." It shall be 
21mailed to the owner or legal representative of the owner named 
22in the original Display certificate of title and in the 
23certificate of title. Such duplicate Display certificate of 
24title shall be attached and displayed in the same manner and in 
25the same place as the original Display certificate of title 
26would have been attached and displayed had it not been lost,

1stolen, mutilated or destroyed or had it not become illegible.

4    Sec. 3-111.1. Corrected certificates. An application for a 
5corrected certificate of title must state the current vehicle 
6odometer reading at the time of application and that the 
7stated odometer reading is one of the following: actual 
8mileage, not the actual mileage or mileage is in excess of its 
9mechanical limits. The corrected certificate issued under this 
10Section shall contain the notation "corrected". A certificate 
11of title or a corrected certificate of title issued by another 
12State showing an Illinois address for the owner cannot be used 
13to transfer ownership of a vehicle. The owner of a vehicle with 
14a certificate of title or duplicate certificate of title 
15issued by another state showing an Illinois address cannot 
16transfer ownership of the vehicle without first converting the 
17certificate of title to an Illinois certificate of title.
