AMENDMENT TO SENATE BILL 898

2    AMENDMENT NO. ______. Amend Senate Bill 898 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Sections 3-101, 3-111, and 3-111.1 as follows:
 
6    (625 ILCS 5/3-101)  (from Ch. 95 1/2, par. 3-101)
7    Sec. 3-101. Certificate of title required.
8    (a) Except as provided in Section 3-102, every owner of a
9vehicle which is in this State and for which no Illinois
10certificate of title has been issued by the Secretary of State
11shall make application to the Secretary of State for an
12Illinois a certificate of title of the vehicle. Except as
13provided in Section 3-102, every owner of a vehicle, excluding
14vehicles acquired by insurance companies through a settlement
15of an insurance claim or by lienholders taking title through
16repossession, that is in this State for which no Illinois

1certificate of title has been issued by the Secretary of State
2and every owner of a vehicle that is in the State applying for
3a duplicate certificate of title or a corrected certificate of
4title, including a dealer lien release certificate of title,
5must make application to the Secretary of State for an
6Illinois duplicate certificate of title or corrected
7certificate of title. A certificate of title issued to any
8owner of a vehicle, excluding vehicles acquired by insurance
9companies through a settlement of an insurance claim or by
10lienholders taking title through repossession, in this State
11showing an Illinois address for the owner that has been issued
12by an entity other than the Secretary of State must be
13converted to an Illinois title before the owner can transfer
14ownership of the vehicle.
15    Under no circumstances shall a dealer required to obtain
16an Illinois certificate of title pursuant to this Code be
17allowed to obtain an out-of-state certificate of title for
18purposes of a vehicle held for sale in this State by the
19dealer. Under no circumstances shall a dealer be allowed to
20obtain an out-of-state certificate of title in lieu of an
21Illinois-issued dealer lien release certificate of title when
22a dealer may have need of such title issuance. Nothing in this
23Section shall be construed so as to allow a dealer to acquire
24an out-of-state certificate of title in lieu of acquiring an
25Illinois certificate of title for purposes of a vehicle held
26for sale in this State by the dealer.

1    (b) Every owner of a motorcycle or motor driven cycle
2purchased new on and after January 1, 1980 shall make
3application to the Secretary of State for a certificate of
4title. However, if such cycle is not properly manufactured or
5equipped for general highway use pursuant to the provisions of
6this Act, it shall not be eligible for license registration,
7but shall be issued a distinctive certificate of title except
8as provided in Sections 3-102 and 3-110 of this Act.
9    (c) The Secretary of State shall not register or renew the
10registration of a vehicle unless a certificate of title has
11been issued by the Secretary of State to the owner or an
12application therefor has been delivered by the owner to the
13Secretary of State.
14    (d) Every owner of an all-terrain vehicle or off-highway
15motorcycle purchased on or after January 1, 1998 shall make
16application to the Secretary of State for a certificate of
17title.
18    (e) Every owner of a low-speed vehicle manufactured after
19January 1, 2010 shall make application to the Secretary of
20State for a certificate of title.

23    Sec. 3-111. Lost, stolen or mutilated certificates. (a) If
24a certificate of title is lost, stolen, mutilated or destroyed
25or becomes illegible, the first lienholder or, if none, the

1owner or legal representative of the owner named in the
2certificate, as shown by the records of the Secretary of
3State, shall promptly make application to the Secretary of
4State for and may obtain a duplicate upon furnishing
5information satisfactory to the Secretary of State. The
6duplicate certificate of title shall contain the legend "This
7is a duplicate certificate and may be subject to the rights of
8a person under the original certificate." It shall be mailed
9to the first lienholder named in it or, if none, to the owner
10or the owner's designee. A certificate of title or a duplicate
11certificate of title issued by another State showing an
12Illinois address for the owner cannot be used to transfer
13ownership of a vehicle, except if the transfer is to or from an
14insurance company or a lienholder of the vehicle through
15repossession.
16    (b) The Secretary of State shall not issue a duplicate
17certificate of title to any person within 15 days after the
18issuance of an original certificate of title to such person.
19    (c) A person recovering an original certificate of title
20for which a duplicate has been issued shall promptly surrender
21the original certificate to the Secretary of State.
22    (d) An application for a duplicate certificate of title
23must state the current vehicle odometer reading at the time of
24application and that the stated odometer reading is one of the
25following: actual mileage, not the actual mileage or mileage
26is in excess of its mechanical limits.

1    (e) If a Display certificate of title is lost, stolen,
2mutilated or destroyed or becomes illegible, the owner or
3legal representative of the owner named in the original
4Display certificate of title and in the certificate of title,
5as shown by the records of the Secretary of State, shall
6promptly make application for and may obtain a duplicate upon
7furnishing information satisfactory to the Secretary of State.
8The duplicate Display certificate of title shall contain the
9legend "Duplicate Display Certificate of Title." It shall be
10mailed to the owner or legal representative of the owner named
11in the original Display certificate of title and in the
12certificate of title. Such duplicate Display certificate of
13title shall be attached and displayed in the same manner and in
14the same place as the original Display certificate of title
15would have been attached and displayed had it not been lost,
16stolen, mutilated or destroyed or had it not become illegible.

19    Sec. 3-111.1. Corrected certificates. An application for a
20corrected certificate of title must state the current vehicle
21odometer reading at the time of application and that the
22stated odometer reading is one of the following: actual

24mechanical limits. The corrected certificate issued under this
25Section shall contain the notation "corrected". A certificate

1of title or a corrected certificate of title issued by another
2State showing an Illinois address for the owner cannot be used
3to transfer ownership of a vehicle, except if the transfer is
4to or from an insurance company or a lienholder of the vehicle
5through repossession. The owner of a vehicle with a
6certificate of title or duplicate certificate of title issued
7by another state showing an Illinois address cannot transfer
8ownership of the vehicle without first converting the
9certificate of title to an Illinois certificate of title,
10except if the transfer is to or from an insurance company or a
11lienholder of the vehicle through repossession.

13    Section 99. Effective date. This Act takes effect upon
