AMENDMENT TO SENATE BILL 1559

2    AMENDMENT NO. ______. Amend Senate Bill 1559 by replacing 
3everything after the enacting clause with the following:
 
4    "Section 5. The Cannabis Regulation and Tax Act is amended 
5by changing Section 40-5 as follows:
 
6    (410 ILCS 705/40-5)
7    Sec. 40-5. Issuance of licenses. 
8    (a) The Department shall issue transporting licenses 
9through a process provided for in this Article no later than 
10July 1, 2020. 
11    (b) The Department shall make the application for 
12transporting organization licenses available on January 7, 
132020 and shall receive such applications no later than March 
1415, 2020. The Department of Agriculture shall make available 
15such applications on every January 7 thereafter or if that 
16date falls on a weekend or holiday, the business day

1immediately succeeding the weekend or holiday and shall 
2receive such applications no later than March 15 or the 
3succeeding business day thereafter. 
4    (c) Entities awarded a license under this Article shall 
5not be required to pay any fee required under Section 40-10 of 
6this Article, the nonrefundable renewal fee required under 
7Section 40-40 of this Article, or any other license fee 
8required under this Article or by rule from January 1, 2024 to 
9January 1, 2027. 
10    (d) From January 1, 2023 through January 1, 2027, the 
11Department shall not make the application available for 
12transporting organization licenses. 
13    (e) Upon completion of the disparity and availability 
14study published by the Illinois Cannabis Regulation Oversight 
15Officer under subsection (e) of Section 5-45, the Department 
16may modify or change the licensing application process to 
17reduce or eliminate barriers and remedy discrimination 
18identified in the study. Beginning January 1, 2027, the 
19Department of Agriculture shall make the applications 
20available on every January 7 thereafter or, if that date falls 
21on a weekend or holiday, the business day immediately 
22succeeding the weekend or holiday and shall receive the 
23applications no later than March 15 or the succeeding business 
24day thereafter.

1    Section 99. Effective date. This Act takes effect upon
