| 1 | AMENDMENT TO SENATE BILL 1769

| 2 | AMENDMENT NO. ______. Amend Senate Bill 1769 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 1. Short title. This Act may be cited as the | ||||||
| 5 | Government Zero-Emission Vehicle Act. | ||||||
| 6 | Section 5. Definitions. As used in this Act: | ||||||
| 7 | "Agency" means the Environmental Protection Agency. | ||||||
| 8 | "Governmental unit" means the State, a State agency, a | ||||||
| 9 | unit of local government, or any other political subdivision | ||||||
| 10 | of the State. | ||||||
| 11 | "Zero-emission vehicle" means a passenger motor vehicle | ||||||
| 12 | that produces zero exhaust emissions of any criteria | ||||||
| 13 | pollutant, precursor pollutant, or greenhouse gas, but only | ||||||
| 14 | produces water vapor, in any mode of operation or condition, | ||||||
| 15 | as determined by the Agency.

| 1 | Section 10. Zero-emission vehicles of governmental units. | ||||||
| 2 | Notwithstanding any other provision of law, all vehicles | ||||||
| 3 | purchased or leased by a governmental unit after January 1, | ||||||
| 4 | 2025 must be either a manufactured zero-emission vehicle or a | ||||||
| 5 | converted zero-emission vehicle. | ||||||
| 6 | Section 15. Rules. The Environmental Protection Agency | ||||||
| 7 | must adopt rules to implement and enforce this Act. | ||||||
| 8 | Section 90. Home rule. A home rule unit may not regulate | ||||||
| 9 | the unit's vehicles in a manner inconsistent with this Act. | ||||||
| 10 | This Act is a limitation under subsection (i) of Section 6 of | ||||||
| 11 | Article VII of the Illinois Constitution on the concurrent | ||||||
| 12 | exercise by home rule units of powers and functions exercised | ||||||
| 13 | by the State.

| 14 | Section 95. The State Mandates Act is amended by adding | ||||||
| 15 | Section 8.47 as follows: | ||||||
| 16 | (30 ILCS 805/8.47 new) | ||||||
| 17 | Sec. 8.47. Exempt mandate. Notwithstanding Sections 6 and | ||||||
| 18 | 8 of this Act, no reimbursement by the State is required for | ||||||
| 19 | the implementation of any mandate created by the Government | ||||||
| 20 | Zero-Emission Vehicle Act.".
