| 7 | | subject to applicable notice requirements. However, if the |
| 8 | | assessment being made available to review is subject to |
| 9 | | copyright, trademark, or other intellectual property |
| 10 | | protection, the review process shall include technical and |
| 11 | | procedural safeguards to ensure that the materials are not |
| 12 | | able to be widely disseminated to the general public in |
| 13 | | violation of the intellectual property rights of the publisher |
| 14 | | and to ensure content validity is not undermined. |

| 17 | | (a) As used in this Section, "district-administered |
| 18 | | assessment" means an assessment that requires all student test |
| 19 | | takers at any grade level to answer the same questions, or a |
| 20 | | selection of questions from a common bank of questions, in the |
| 21 | | same manner or substantially the same questions in the same |
| 22 | | manner. The term does not include an observational assessment |
| 23 | | tool used to satisfy the requirements of Section 2-3.64a-10 of |
| 24 | | this Code or an assessment developed by district teachers or |
| 25 | | administrators that will be used to measure student progress |
