SYNOPSIS AS INTRODUCED:

105 ILCS 5/2-3.104a new

Amends the School Code. Requires the State Board of Education to create a Committee on Mandate Review. Provides that the purpose of the committee is to complete a statewide review of State mandates on school districts. Sets forth the membership of the committee. Contains provisions concerning meetings, administrative support, and reporting. Repeals these provisions on December 31, 2025. Effective immediately.

A BILL FOR

AN ACT concerning education.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The School Code is amended by adding Section 2-3.104a as follows:

(105 ILCS 5/2-3.104a new)

Sec. 2-3.104a. Committee on Mandate Review.

(a) In this Section, "school district category" includes unit school districts, rural school districts, suburban school districts, and a school district organized under Article 34 of this Code.

(b) The State Board of Education shall create a Committee on Mandate Review for the purpose of completing a statewide review of State mandates on school districts.

(c) The membership of the committee shall include, but is not limited to, all of the following members:

(1) The State Superintendent of Education or a designee who shall serve as chairperson.

(2) One member representing a statewide association of regional superintendents of schools appointed by the chairperson of the State Board of Education.

(3) Two members appointed by the Speaker of the House of Representatives.

(4) Two members appointed by the Minority Leader of the House of Representatives.

(5) Two members appointed by the President of the Senate.

(6) Two members appointed by the Minority Leader of the Senate.

(7) A representative of a school district organized under Article 34 of this Code appointed by the chairperson of the State Board of Education.

(8) A representative of a statewide organization representing individuals who hold professional educator licenses and are employed by a school district organized under Article 34 of this Code appointed by the chairperson of the State Board of Education.

(9) One regional superintendent of schools representing a suburban school district appointed by the chairperson of the State Board of Education.

(10) One regional superintendent of schools representing a rural school district appointed by the chairperson of the State Board of Education.

(11) One superintendent representing a unit school district appointed by the chairperson of the State Board of Education.

(12) One superintendent representing a high school district appointed by the chairperson of the State Board of Education.

(13) One member representing a statewide association representing school administrators appointed by the chairperson of the State Board of Education.

(14) One member representing a statewide association representing principals appointed by the chairperson of the State Board of Education.

(15) One school business official representing a school district designated as Tier 1 or Tier 2 under Section 18-8.15 of this Code appointed by the chairperson of the State Board of Education.

(16) One school business official representing a school district designated as Tier 1 or Tier 2 under Section 18-8.15 of this Code appointed by the chairperson of the State Board of Education.

(17) One member from an urban area from an organization representing teachers.

(18) One member from a suburban area from an organization representing teachers.

(19) One member from a rural area from an organization representing teachers.

(20) One member from an urban area from an organization representing students.

(21) One member from a suburban area from an organization representing students.

(22) One member from a rural area from an organization representing students.

(d) The committee shall meet at the call of the chairperson. Members of the committee shall serve without compensation but shall be reimbursed for their reasonable and necessary expenses from funds appropriated to the State Board of Education for that purpose, including travel, subject to the rules of the appropriate travel control board. The State Board of Education shall provide administrative and other support to the committee.

(e) The committee shall report its findings and recommendations to the State Board of Education and General Assembly on or before December 1, 2024.

The report shall include, but is not limited to, all of the following items:

(1) An analysis of the cost to implement a mandate by each school district category.

(2) An analysis of the amount of staff time and the number of staff needed to implement the mandate by each school district category.

(3) An analysis of the resources available for the consistent implementation of the mandate by each school district category.

(4) An analysis of the duplication of any mandates that school districts are required to implement and are related to a legislative mandate.

(5) A summary of the practices used by school districts that have been granted waivers of a legislative mandate.

(6) An analysis of the waiver and modification process, including, but not limited to, the role of regional offices of education.

Upon filing its report, the committee is dissolved.

(f) This Section is repealed on December 31, 2025.

Section 99. Effective date. This Act takes effect upon becoming law.
