AMENDMENT TO SENATE BILL 2645

2    AMENDMENT NO. ______. Amend Senate Bill 2645 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Guardianship and Advocacy Act is amended
5by changing Section 33.5 as follows:
 
6    (20 ILCS 3955/33.5)
7    Sec. 33.5. Guardianship training program. The State
8Guardian shall provide a training program that outlines the
9duties and responsibilities of guardians appointed under
10Article XIa of the Probate Act of 1975. The training program
11shall be offered to courts at no cost, and shall outline the
12responsibilities of a guardian and the rights of a person with
13a disability in a guardianship proceeding under Article XIa of
14the Probate Act of 1975. Beginning on the effective date of
15this amendatory Act of the 103rd General Assembly, the The
16training program shall also include content regarding

1Alzheimer's disease and dementia, including, but not limited
2to, the following topics: effective communication strategies;
3best practices for interacting with people living with
4Alzheimer's disease or related forms of dementia; and
5strategies for supporting people living with Alzheimer's
6disease or related forms of dementia in exercising their
7rights. In developing the training program content, the State
8Guardian shall consult with the courts, State and national
9guardianship organizations, public guardians, advocacy
10organizations, and persons and family members with direct
11experience with adult guardianship. In the preparation and
12dissemination of training materials, the State Guardian shall
13give due consideration to making the training materials
14accessible to persons with disabilities.

16    Section 10. The Probate Act of 1975 is amended by changing
17Section 13-1.2 as follows:
 
18    (755 ILCS 5/13-1.2)
19    Sec. 13-1.2. Certification requirement. Each person
20appointed as a public guardian by the Governor shall be
21certified as a National Certified Guardian by the Center for
22Guardianship Certification within 6 months after his or her
23appointment. The Guardianship and Advocacy Commission shall
24provide public guardians with information about certification

1requirements and procedures for testing and certification
2offered by the Center for Guardianship Certification. The cost
3of certification shall be considered an expense connected with
4the operation of the public guardian's office within the
5meaning of subsection (b) of Section 13-3.1 of this Article.
6    Beginning on the effective date of this amendatory Act of
7the 103rd General Assembly, a A public guardian shall
8additionally complete a one-hour course regarding Alzheimer's
9disease and dementia within 6 months of appointment and
10annually thereafter. The training program shall include, but
11not be limited to, the following topics: effective
12communication strategies; best practices for interacting with
13people with Alzheimer's disease and related forms of dementia;
14and strategies for supporting people living with Alzheimer's
15disease or related forms of dementia in exercising their
16rights.

18    Section 99. Effective date. This Act takes effect upon
19becoming law.".
