1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois, 
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by adding Section 
55-12022 as follows:
 
6    (55 ILCS 5/5-12022 new)
7    Sec. 5-12022. Building permit fee for veterans with a 
8disability.
9    (a) A veteran with a disability or the veteran's caregiver 
10shall not be charged any building permit fee for improvements 
11to the residence of the veteran with a disability if the 
12improvements are required to accommodate a disability of the 
13veteran. Nothing in this subsection changes the obligation of 
14any person to submit to the county applications, forms, or 
15other paperwork to obtain a building permit. A veteran or 
16caregiver must provide proof of veteran status and attest to 
17the fact that the improvements to the residence are required 
18to accommodate the veteran's disability. Proof of veteran 
19status is to be construed liberally, and veteran status shall 
20include service in the Armed Forces of the United States, 
21National Guard, or the reserves of the Armed Forces of the 
22United States.
23    (b) What constitutes proof of veteran status shall be

1determined by the county. The Illinois Department of Veterans' 
2Affairs may not adjudicate any dispute arising under paragraph 
3(a).
4    (c) A home rule county may not regulate building permit 
5fees in a manner inconsistent with this Section. This Section 
6is a limitation under subsection (i) of Section 6 of Article 
7VII of the Illinois Constitution on the concurrent exercise by 
8home rule units of powers and functions exercised by the 
9State. 
 
10    Section 10. The Township Code is amended by adding Section 
11110-17 as follows:
 
12    (60 ILCS 1/110-17 new)
13    Sec. 110-17. Building permit fee for veterans with a 
14disability. A veteran with a disability or the veteran's 
15caregiver shall not be charged any building permit fee for 
16improvements to the residence of the veteran with a disability 
17if the improvements are required to accommodate a disability 
18of the veteran. Nothing in this Section changes the obligation 
19of any person to submit to the township applications, forms, 
20or other paperwork to obtain a building permit. A veteran or 
21caregiver must provide proof of veteran status and attest to 
22the fact that the improvements to the residence are required 
23to accommodate the veteran's disability. Proof of veteran

7    Section 15. The Illinois Municipal Code is amended by 
8adding Section 11-13-28 as follows:

10    Sec. 11-13-28. Building permit fee for veterans with a 
11disability.
12    (a) A veteran with a disability or the veteran's caregiver 
13shall not be charged any building permit fee for improvements 
14to the residence of the veteran with a disability if the 
15improvements are required to accommodate a disability of the 
16veteran. Nothing in this subsection changes the obligation of 
17any person to submit to the municipality applications, forms, 
18or other paperwork to obtain a building permit. A veteran or 
19caregiver must provide proof of veteran status and attest to
