| 1 | | AN ACT concerning local government. |
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly: |
| 4 | | Section 5. The Counties Code is amended by adding Section |
| 5 | | 5-12022 as follows: |
| 6 | | (55 ILCS 5/5-12022 new) |
| 7 | | Sec. 5-12022. Building permit fee for veterans with a |
| 8 | | disability. |
| 9 | | (a) A veteran with a disability or the veteran's caregiver |
| 10 | | shall not be charged any building permit fee for improvements |
| 11 | | to the residence of the veteran with a disability if the |
| 12 | | improvements are required to accommodate a disability of the |
| 13 | | veteran. Nothing in this subsection changes the obligation of |
| 14 | | any person to submit to the county applications, forms, or |
| 15 | | other paperwork to obtain a building permit. A veteran or |
| 16 | | caregiver must provide proof of veteran status and attest to |
| 17 | | the fact that the improvements to the residence are required |
| 18 | | to accommodate the veteran's disability. Proof of veteran |
| 19 | | status is to be construed liberally, and veteran status shall |
| 20 | | include service in the Armed Forces of the United States, |
| 21 | | National Guard, or the reserves of the Armed Forces of the |
| 22 | | United States. |
| 23 | | (b) What constitutes proof of veteran status shall be |

| 1 | | determined by the county. The Illinois Department of Veterans' |
| 2 | | Affairs may not adjudicate any dispute arising under paragraph |
| 3 | | (a). |
| 4 | | (c) A home rule county may not regulate building permit |
| 5 | | fees in a manner inconsistent with this Section. This Section |
| 6 | | is a limitation under subsection (i) of Section 6 of Article |
| 7 | | VII of the Illinois Constitution on the concurrent exercise by |
| 8 | | home rule units of powers and functions exercised by the |
| 9 | | State. |
| 10 | | Section 10. The Township Code is amended by adding Section |
| 11 | | 110-17 as follows: |
| 12 | | (60 ILCS 1/110-17 new) |
| 13 | | Sec. 110-17. Building permit fee for veterans with a |
| 14 | | disability. A veteran with a disability or the veteran's |
| 15 | | caregiver shall not be charged any building permit fee for |
| 16 | | improvements to the residence of the veteran with a disability |
| 17 | | if the improvements are required to accommodate a disability |
| 18 | | of the veteran. Nothing in this Section changes the obligation |
| 19 | | of any person to submit to the township applications, forms, |
| 20 | | or other paperwork to obtain a building permit. A veteran or |
