SYNOPSIS AS INTRODUCED:
 
20 ILCS 405/405-545 new
20 ILCS 2205/2205-45 new

    Amends the Department of Central Management Services Law of the Civil Administrative Code of Illinois. Provides that the Department of Central Management Services, in conjunction with the State Employees Retirement System, shall enter into a contract with a qualified and experienced administrator to establish and conduct a State Retiree Medicare Primacy Coordination Audit and Assistance Program to identify retirees who are eligible for Medicare, but not enrolled in Medicare, and to assist those retirees in enrolling in Social Security and Medicare. Provides further duties and requirements for the program. Amends the Department of Healthcare and Family Services Law of the Civil Administrative Code of Illinois. Provides that the Department of Healthcare and Family Services shall enter into a contract with a qualified and experienced administrator to establish and conduct a Medicare Primacy Coordination Audit and Assistance Program to identify Medicaid recipients who could benefit from Social Security Disability Insurance representation that could provide them with income and ultimately Medicare benefits. Provides further duties and requirements for the program. Sets forth reporting requirements. Effective January 1, 2025.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Central Management Services
5Law of the Civil Administrative Code of Illinois is amended by
6adding Section 405-545 as follows:
 
7    (20 ILCS 405/405-545 new)
8    Sec. 405-545. State Retiree Medicare Primacy Coordination
9Audit and Assistance Program.
10    (a) Within 6 months after the effective date of this
11amendatory Act of the 103rd General Assembly, the Department
12of Central Management Services, in conjunction with the State
13Employees Retirement System, shall enter into a contract with
14a qualified and experienced administrator to establish and
15conduct a State Retiree Medicare Primacy Coordination Audit
16and Assistance Program to identify retirees who are eligible
17for Medicare, but not enrolled in Medicare, and to assist
18those retirees in enrolling in Social Security and Medicare.
19    (b) The Program shall conduct an annual audit of the State
20Health Benefits Program for State of Illinois retirees for the
21purpose of identifying participants and their dependents who
22are eligible for Medicare under federal law. The Program shall
23also ensure that those retirees or their dependents who are

1eligible for Medicare are enrolled in Medicare with Medicare
2as their primary health care benefits coverage and the State
3Health Benefits Program being the secondary provider of their
4health care benefits coverage.
5    (c) The Program shall assist any retiree or dependent who
6becomes disabled and is not enrolled in Social Security
7Disability Insurance and Medicare with enrolling in and
8obtaining Social Security Disability Insurance and Medicare
9benefits. This assistance shall include, but not be limited
10to: (i) developing communication materials to educate retirees
11about Social Security Disability Insurance benefits; (ii)
12performing multiple outreaches to targeted populations; (iii)
13analyzing responses to determine Social Security Disability
14Insurance eligibility; and (iv) representing qualified
15individuals on their claim for Social Security Disability
16Insurance and Medicare.
17    (d) The administrator shall provide the Department, the
18State Employees Retirement System, and the General Assembly
19with an annual report showing the number of retirees and
20dependents who are transitioned to Social Security Disability
21Insurance and Medicare and the amount of savings realized by
22the State of Illinois.
 
23    Section 10. The Department of Healthcare and Family
24Services Law of the Civil Administrative Code of Illinois is
25amended by adding Section 2205-45 as follows:

2    Sec. 2205-45. Medicare Primacy Coordination Audit and
3Assistance Program.
4    (a) Within 6 months after the effective date of this
5amendatory Act of the 103rd General Assembly, the Department
6of Healthcare and Family Services shall enter into a contract
7with a qualified and experienced administrator to establish
8and conduct a Medicare Primacy Coordination Audit and
9Assistance Program to identify Medicaid recipients who could
10benefit from Social Security Disability Insurance
11representation that could provide them with income and
12ultimately Medicare benefits.
13    (b) The Program shall conduct an ongoing claims analysis
14of adults receiving Medicaid for the purpose of identifying
15high cost participants who may be eligible for Social Security
16Disability Insurance.
17    (c) The Program shall assist any adult who claims
18disability and Social Security eligibility to apply for and be
19awarded Social Security Disability Insurance benefits and
20subsequently Medicare. This assistance shall include, but not
21be limited to: (i) developing communication materials to
22educate Medicaid recipients about Social Security Disability
23Insurance benefits; (ii) performing multiple outreaches to
24populations targeted by claims analysis; (iii) analyzing
25responses to determine Social Security Disability Insurance

1eligibility; and (iv) representing qualified individuals on
2their claim for Social Security Disability Insurance and
3Medicare.
4    (d) The administrator shall provide the Department of
5Healthcare and Family Services and the General Assembly with
6an annual report showing the number of Medicaid recipients who
7have transitioned to Social Security Disability Insurance and
8Medicare and the amount of savings realized by the State of
9Illinois.
 
10    Section 99. Effective date. This Act takes effect January
111, 2025.
