SYNOPSIS AS INTRODUCED:
 
225 ILCS 325/5  from Ch. 111, par. 5205

    Amends the Professional Engineering Practice Act of 1989. Requires the rules the Department of Financial and Professional Regulations adopts as to what constitutes a professional engineering or related science curriculum to include bachelor degree programs in engineering technology as professional engineering or related science curriculum.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Professional Engineering Practice Act of
51989 is amended by changing Section 5 as follows:
 
6    (225 ILCS 325/5)  (from Ch. 111, par. 5205)
7    (Section scheduled to be repealed on January 1, 2030)
8    Sec. 5. Powers and duties of the Department. The
9Department shall exercise, subject to the provisions of this
10Act, the following functions, powers, and duties:
11        (a) Authorize examinations to ascertain the fitness
12    and qualifications of applicants for licensure and pass
13    upon the qualifications and fitness of applicants for
14    licensure by endorsement.
15        (b) Adopt rules required for the administration of
16    this Act.
17        (c) Conduct hearings on proceedings to refuse to issue
18    or renew, restore, revoke, or suspend licenses or place on
19    probation or reprimand persons or entities licensed under
20    the provisions of this Act.
21        (d) Issue licenses to those who meet the requirements
22    of this Act.
23        (e) Adopt rules as to what shall constitute a

1    professional engineering or related science curriculum.
2    Rules adopted by the Department shall accept bachelor
3    degree programs in engineering technology as professional
4    engineering or related science curriculum.
5        (f) Adopt rules for what constitutes professional
6    engineering experience.
7        (g) Maintain membership in the National Council of
8    Examiners for Engineering and Surveying and participate in
9    activities of the Council by designation of individuals
10    for the various classifications of membership, the
11    appointment of delegates for attendance at zone and
12    national meetings of the Council, and the funding of the
13    delegates for attendance at the meetings of the Council.
14        (h) Adopt rules for standards of professional conduct.
15        (i) Obtain written recommendations from the Board
16    regarding qualifications of individuals for licensure and
17    enrollment, definitions of curriculum content and approval
18    of engineering curricula, standards of professional
19    conduct and formal disciplinary actions, and the adoption
20    of the rules affecting these matters.
21        Upon the issuance of any final decision or order that
22    deviates from any report or recommendation of the Board
23    relating to the qualification of applicants, discipline of
24    licensees or registrants, or adoption of rules, the
25    Secretary shall notify the Board on any such deviation and
26    shall specify with particularity the reasons for the

1    action in the final decision or order. The Department may
2    at any time seek the expert advice and knowledge of the
3    Board on any matter relating to the enforcement of this
4    Act.
5        (i) Post on the Department's website, a newsletter
6    describing the most recent changes in this Act and the
7    rules adopted under this Act and containing information of
8    any final disciplinary action that has been ordered under
9    this Act since the date of the last newsletter.
10        (j) Review such applicant qualifications to sit for
11    the examination or for licensure as the Board designates
12    pursuant to Section 7 of this Act.
13        (k) Conduct investigations related to possible
14    violations of this Act.
