SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/12-6  from Ch. 38, par. 12-6

    Amends the Criminal Code of 2012. Provides that a person commits intimidation when, with intent to cause another person to perform or to omit the performance of any act, including, but not limited to, the transfer of money, goods, services, or other things of value to the person or another person directed by the person, he or she communicates to the other person, directly or indirectly by any means, a threat to report the other person's immigration or suspected immigration status to U.S. Immigration and Customs Enforcement, another federal agency involved in immigration enforcement, or any other person without consent of the person whose immigration status the person wishes to disclose.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Code of 2012 is amended by
5changing Section 12-6 as follows:
 
6    (720 ILCS 5/12-6)  (from Ch. 38, par. 12-6)
7    Sec. 12-6. Intimidation.
8    (a) A person commits intimidation when, with intent to
9cause another to perform or to omit the performance of any act,
10he or she communicates to another, directly or indirectly by
11any means, a threat to perform without lawful authority any of
12the following acts:
13        (1) Inflict physical harm on the person threatened or
14    any other person or on property; or
15        (2) Subject any person to physical confinement or
16    restraint; or
17        (3) Commit a felony or Class A misdemeanor; or
18        (4) Accuse any person of an offense; or
19        (5) Expose any person to hatred, contempt or ridicule;
20    or
21        (6) Take action as a public official against anyone or
22    anything, or withhold official action, or cause such
23    action or withholding; or

1        (7) Bring about or continue a strike, boycott or other
2    collective action.
3    (a-5) A person commits intimidation when, with intent to
4cause another person to perform or to omit the performance of
5any act, including, but not limited to, the transfer of money,
6goods, services, or other things of value to the person or
7another person directed by the person, he or she communicates
8to the other person, directly or indirectly by any means, a
9threat to report the other person's immigration or suspected
10immigration status to U.S. Immigration and Customs
11Enforcement, another federal agency involved in immigration
12enforcement, or any other person without consent of the person
13whose immigration status the person wishes to disclose.
14    (b) Sentence.
15    Intimidation is a Class 3 felony for which an offender may
16be sentenced to a term of imprisonment of not less than 2 years
17and not more than 10 years.
