2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly: |
4 | | Section 5. The School Code is amended by changing Section |
5 | | 10-22.39 and by adding Section 34-18.85 as follows: |

9 | | Sec. 10-22.39. In-service training programs. |
10 | | (a) To conduct in-service training programs for teachers. |
11 | | (b) In addition to other topics at in-service training |
12 | | programs, at least once every 2 years, licensed school |
13 | | personnel and administrators who work with pupils in |
14 | | kindergarten through grade 12 shall be trained to identify the |
15 | | warning signs of mental illness, trauma, and suicidal behavior |
16 | | in youth and shall be taught appropriate intervention and |
17 | | referral techniques. A school district may utilize the |
18 | | Illinois Mental Health First Aid training program, established |
19 | | under the Illinois Mental Health First Aid Training Act and |
20 | | administered by certified instructors trained by a national |
21 | | association recognized as an authority in behavioral health, |
22 | | to provide the training and meet the requirements under this |
23 | | subsection. If licensed school personnel or an administrator |

1 | | obtains mental health first aid training outside of an |
2 | | in-service training program, he or she may present a |
3 | | certificate of successful completion of the training to the |
4 | | school district to satisfy the requirements of this |
5 | | subsection. |
6 | | Training regarding the implementation of trauma-informed |
7 | | practices satisfies the requirements of this subsection (b). |
8 | | A course of instruction as described in this subsection |
9 | | (b) must include the definitions of trauma, trauma-responsive |
10 | | learning environments, and whole child set forth in subsection |
11 | | (b) of Section 3-11 of this Code and may provide information |
12 | | that is relevant to and within the scope of the duties of |
13 | | licensed school personnel or school administrators. Such |
14 | | information may include, but is not limited to: |
15 | | (1) the recognition of and care for trauma in students |
16 | | and staff; |
17 | | (2) the relationship between educator wellness and |
18 | | student learning; |
19 | | (3) the effect of trauma on student behavior and |
20 | | learning; |
21 | | (4) the prevalence of trauma among students, including |
22 | | the prevalence of trauma among student populations at |
23 | | higher risk of experiencing trauma; |
24 | | (5) the effects of implicit or explicit bias on |
25 | | recognizing trauma among various student groups in |
26 | | connection with race, ethnicity, gender identity, sexual |

1 | | orientation, socio-economic status, and other relevant |
2 | | factors; and |
3 | | (6) effective district practices that are shown to: |
4 | | (A) prevent and mitigate the negative effect of |
5 | | trauma on student behavior and learning; and |
6 | | (B) support the emotional wellness of staff. |
7 | | (c) School counselors, nurses, teachers and other school |
8 | | personnel who work with pupils may be trained to have a basic |
9 | | knowledge of matters relating to acquired immunodeficiency |
10 | | syndrome (AIDS), including the nature of the disease, its |
11 | | causes and effects, the means of detecting it and preventing |
12 | | its transmission, and the availability of appropriate sources |
13 | | of counseling and referral, and any other information that may |
14 | | be appropriate considering the age and grade level of such |
15 | | pupils. The School Board shall supervise such training. The |
16 | | State Board of Education and the Department of Public Health |
17 | | shall jointly develop standards for such training. |
18 | | (d) In this subsection (d): |
19 | | "Domestic violence" means abuse by a family or household |
20 | | member, as "abuse" and "family or household members" are |
21 | | defined in Section 103 of the Illinois Domestic Violence Act |
22 | | of 1986. |
23 | | "Sexual violence" means sexual assault, abuse, or stalking |
24 | | of an adult or minor child proscribed in the Criminal Code of |
25 | | 1961 or the Criminal Code of 2012 in Sections 11-1.20, |
26 | | 11-1.30, 11-1.40, 11-1.50, 11-1.60, 12-7.3, 12-7.4, 12-7.5, |

1 | | 12-12, 12-13, 12-14, 12-14.1, 12-15, and 12-16, including |
2 | | sexual violence committed by perpetrators who are strangers to |
3 | | the victim and sexual violence committed by perpetrators who |
4 | | are known or related by blood or marriage to the victim. |
5 | | At least once every 2 years, an in-service training |
6 | | program for school personnel who work with pupils, including, |
7 | | but not limited to, school and school district administrators, |
8 | | teachers, school social workers, school counselors, school |
9 | | psychologists, and school nurses, must be conducted by persons |
10 | | with expertise in domestic and sexual violence and the needs |
11 | | of expectant and parenting youth and shall include training |
12 | | concerning (i) communicating with and listening to youth |
13 | | victims of domestic or sexual violence and expectant and |
14 | | parenting youth, (ii) connecting youth victims of domestic or |
15 | | sexual violence and expectant and parenting youth to |
16 | | appropriate in-school services and other agencies, programs, |
17 | | and services as needed, and (iii) implementing the school |
18 | | district's policies, procedures, and protocols with regard to |
19 | | such youth, including confidentiality. At a minimum, school |
20 | | personnel must be trained to understand, provide information |
21 | | and referrals, and address issues pertaining to youth who are |
22 | | parents, expectant parents, or victims of domestic or sexual |
23 | | violence. |
24 | | (e) At least every 2 years, an in-service training program |
25 | | for school personnel who work with pupils must be conducted by |
26 | | persons with expertise in anaphylactic reactions and |

2 | | (f) At least once every 2 years, a school board shall |
3 | | conduct in-service training on educator ethics, |
4 | | teacher-student conduct, and school employee-student conduct |
5 | | for all personnel. |
6 | | (g) At least once every 2 years, a school board shall |
7 | | conduct in-service training for all school district employees |
8 | | on the methods to respond to trauma. The training must include |
9 | | instruction on how to respond to an incident involving |
10 | | life-threatening bleeding and, if applicable, how to use a |
11 | | school's trauma kit. A school board may satisfy the training |
12 | | requirements under this subsection by using the training, |
13 | | including online training, available from the American College |
14 | | of Surgeons or any other similar organization. |
15 | | School district employees who are trained to respond to |
16 | | trauma pursuant to this subsection (g) shall be immune from |
17 | | civil liability in the use of a trauma kit unless the action |
18 | | constitutes willful or wanton misconduct. |
19 | | (i) Beginning with the 2024-2025 school year, at least |
20 | | once every 2 years, a school board shall conduct in-service |
21 | | training for all school district employees on how to identify |
22 | | trafficking in persons under Section 10-9 of the Criminal Code |
23 | | of 2012. |

4 | | (a) To conduct in-service training programs for teachers, |
5 | | administrators, and school support personnel. |
6 | | (b) In addition to other topics at in-service training |
7 | | programs listed in this Section, teachers, administrators, and |
8 | | school support personnel who work with pupils must be trained |
9 | | in the following topics: health conditions of students; |
10 | | social-emotional learning; developing cultural competency; |
11 | | identifying warning signs of mental illness and suicidal |
12 | | behavior in youth; domestic and sexual violence and the needs |
13 | | of expectant and parenting youth; protections and |
14 | | accommodations for students; educator ethics; responding to |
15 | | child sexual abuse and grooming behavior; and effective |
16 | | instruction in violence prevention and conflict resolution. |
17 | | In-service training programs in these topics shall be credited |
18 | | toward hours of professional development required for license |
19 | | renewal as outlined in subsection (e) of Section 21B-45. |
20 | | School support personnel may be exempt from in-service |
21 | | training if the training is not relevant to the work they do. |
22 | | Nurses and school nurses, as defined by Section 10-22.23, |
23 | | are exempt from training required in subsection (b-5). |
24 | | Beginning July 1, 2024, all teachers, administrators, and |
25 | | school support personnel shall complete training as outlined |

1 | | in Section 10-22.39 during an in-service training program |
2 | | conducted by their school board or through other training |
3 | | opportunities, including, but not limited to, institutes under |
4 | | Section 3-11. Such training must be completed within 6 months |
5 | | of employment by a school board and renewed at least once every |
6 | | 5 years, unless required more frequently by other State or |
7 | | federal law or in accordance with this Section. If teachers, |
8 | | administrators, or school support personnel obtain training |
9 | | outside of an in-service training program or from a previous |
10 | | public school district or nonpublic school employer, they may |
11 | | present documentation showing current compliance with this |
12 | | subsection to satisfy the requirement of receiving training |
13 | | within 6 months of first being employed. Training may be |
14 | | delivered through online, asynchronous means. |
15 | | (b-5) Training regarding health conditions of students for |
16 | | staff required by this Section shall include, but is not |
17 | | limited to: |
18 | | (1) Chronic health conditions of students. |
19 | | (2) Anaphylactic reactions and management. Such |
20 | | training shall be conducted by persons with expertise in |
21 | | anaphylactic reactions and management. |
22 | | (3) The management of asthma, the prevention of asthma |
23 | | symptoms, and emergency response in the school setting. |
24 | | (4) The basics of seizure recognition and first aid |
25 | | and appropriate emergency protocols. Such training must be |
26 | | fully consistent with the best practice guidelines issued |

1 | | by the Centers for Disease Control and Prevention. |
2 | | (5) The basics of diabetes care, how to identify when |
3 | | a student with diabetes needs immediate or emergency |
4 | | medical attention, and whom to contact in the case of an |
5 | | emergency. |
6 | | (6) Current best practices regarding the |
7 | | identification and treatment of attention deficit |
8 | | hyperactivity disorder. |
9 | | (7) Instruction on how to respond to an incident |
10 | | involving life-threatening bleeding and, if applicable, |
11 | | how to use a school's trauma kit. Beginning with the |
12 | | 2024-2025 school year, training on life-threatening |
13 | | bleeding must be completed within 6 months of the employee |
14 | | first being employed by a school board and renewed within |
15 | | 2 years. Beginning with the 2027-2028 school year, the |
16 | | training must be completed within 6 months of the employee |
17 | | first being employed by a school board and renewed at |
18 | | least once every 5 years thereafter. |
19 | | In consultation with professional organizations with |
20 | | expertise in student health issues, including, but not limited |
21 | | to, asthma management, anaphylactic reactions, seizure |
22 | | recognition, and diabetes care, the State Board of Education |
23 | | shall make available resource materials for educating school |
24 | | personnel about student health conditions and emergency |
25 | | response in the school setting. |
26 | | A school board may satisfy the life-threatening bleeding |

1 | | training under this subsection by using the training, |
2 | | including online training, available from the American College |
3 | | of Surgeons or any other similar organization. |
4 | | (b-10) The training regarding social-emotional learning , |
5 | | for staff required by this Section may include, at a minimum, |
6 | | providing education to all school personnel about the content |
7 | | of the Illinois Social and Emotional Learning Standards, how |
8 | | those standards apply to everyday school interactions, and |
9 | | examples of how social emotional learning can be integrated |
10 | | into instructional practices across all grades and subjects. |
11 | | (b-15) The training regarding developing cultural |
12 | | competency for staff required by this Section shall include, |
13 | | but is not limited to, understanding and reducing implicit |
14 | | bias, including implicit racial bias. As used in this |
15 | | subsection, "implicit racial bias" has the meaning set forth |
16 | | in Section 10-20.61. |
17 | | (b-20) The training regarding identifying warning signs of |
18 | | mental illness, trauma, and suicidal behavior in youth for |
19 | | staff required by this Section shall include, but is not |
20 | | limited to, appropriate intervention and referral techniques, |
21 | | including resources and guidelines as outlined in Section |
22 | | 2-3.166 , and must include the definitions of trauma, |
23 | | trauma-responsive learning environments, and whole child set |
24 | | forth in subsection (b) of Section 3-11 of this Code . |
25 | | Illinois Mental Health First Aid training, established |
26 | | under the Illinois Mental Health First Aid Training Act, may |

25 | | domestic and sexual violence and the needs of expectant and |
26 | | parenting youth, and shall include, but is not limited to: |

13 | | to youth who are parents, expectant parents, or victims of |
14 | | domestic or sexual violence; and |
15 | | (4) procedures for responding to incidents of teen |
16 | | dating violence that take place at the school, on school |
17 | | grounds, at school-sponsored activities, or in vehicles |
18 | | used for school-provided transportation as outlined in |
19 | | Section 3.10 of the Critical Health Problems and |
20 | | Comprehensive Health Education Act. |
21 | | (b-30) The training regarding protections and |
22 | | accommodations for students shall include, but is not limited |
23 | | to, instruction on the federal Americans with Disabilities |
24 | | Act, as it pertains to the school environment, and |
25 | | homelessness. Beginning with the 2024-2025 school year, |
26 | | training on homelessness must be completed within 6 months of |

1 | | an employee first being employed by a school board and renewed |
2 | | within 2 years. Beginning with the 2027-2028 school year, the |
3 | | training must be completed within 6 months of the employee |
4 | | first being employed by a school board and renewed at least |
5 | | once every 5 years thereafter. Training on homelessness shall |
6 | | include the following: |
7 | | (1) the definition of homeless children and youths |
8 | | under 42 U.S.C. 11434a; |
9 | | (2) the signs of homelessness and housing insecurity; |
10 | | (3) the rights of students experiencing homelessness |
11 | | under State and federal law; |
12 | | (4) the steps to take when a homeless or |
13 | | housing-insecure student is identified; and |
14 | | (5) the appropriate referral techniques, including the |
15 | | name and contact number of the school or school district |
16 | | homeless liaison. |
17 | | School boards may work with a community-based organization |
18 | | that specializes in working with homeless children and youth |
19 | | to develop and provide the training. |
20 | | (b-35) The training regarding educator ethics and |
21 | | responding to child sexual abuse and grooming behavior shall |
22 | | include, but is not limited to, teacher-student conduct, |
23 | | school employee-student conduct, and evidence-informed |
24 | | training on preventing, recognizing, reporting, and responding |
25 | | to child sexual abuse and grooming as outlined in Section |
26 | | 10-23.13. |

1 | | (b-40) The training regarding effective instruction in |
2 | | violence prevention and conflict resolution required by this |
3 | | Section shall be conducted in accordance with the requirements |
4 | | of Section 27-23.4. |
5 | | (b-45) (c) Beginning July 1, 2024, all nonpublic |
6 | | elementary and secondary school teachers, administrators, and |
7 | | school support personnel shall complete the training set forth |
8 | | in subsection (b-5). Training must be completed within 6 |
9 | | months of first being employed by a nonpublic school and |
10 | | renewed at least once every 5 years, unless required more |
11 | | frequently by other State or federal law. If nonpublic |
12 | | teachers, administrators, or school support personnel obtain |
13 | | training from a public school district or nonpublic school |
14 | | employer, the teacher, administrator, or school support |
15 | | personnel may present documentation to the nonpublic school |
16 | | showing current compliance with this subsection to satisfy the |
17 | | requirement of receiving training within 6 months of first |
18 | | being employed. must include the definitions of trauma, |
19 | | trauma-responsive learning environments, and whole child set |
20 | | forth in subsection (b) of Section 3-11 of this Code and |

17 | | personnel about student health conditions and emergency |
18 | | response in the school setting. |
19 | | A school board may satisfy the life-threatening bleeding |
20 | | training under this subsection by using the training, |
21 | | including online training, available from the American College |
22 | | of Surgeons or any other similar organization. |
23 | | (b-10) The training regarding social-emotional learning , |
24 | | for staff required by this Section may include, at a minimum, |
25 | | providing education to all school personnel about the content |
26 | | of the Illinois Social and Emotional Learning Standards, how |

1 | | those standards apply to everyday school interactions, and |
2 | | examples of how social emotional learning can be integrated |
3 | | into instructional practices across all grades and subjects. |
4 | | (b-15) The training regarding developing cultural |
5 | | competency for staff required by this Section shall include, |
6 | | but is not limited to, understanding and reducing implicit |
7 | | bias, including implicit racial bias. As used in this |
8 | | subsection, "implicit racial bias" has the meaning set forth |
9 | | in Section 10-20.61. |
10 | | (b-20) The training regarding identifying warning signs of |
11 | | mental illness, trauma, and suicidal behavior in youth for |
12 | | staff required by this Section shall include, but is not |
13 | | limited to, appropriate intervention and referral techniques, |
14 | | including resources and guidelines as outlined in Section |
15 | | 2-3.166 , and must include the definitions of trauma, |
16 | | trauma-responsive learning environments, and whole child set |
17 | | forth in subsection (b) of Section 3-11 of this Code . |
18 | | Illinois Mental Health First Aid training, established |
19 | | under the Illinois Mental Health First Aid Training Act, may |
20 | | satisfy the requirements of this subsection. |
21 | | If teachers, administrators, or school support personnel |
22 | | obtain mental health first aid training outside of an |
23 | | in-service training program, they may present a certificate of |
24 | | successful completion of the training to the school district |
25 | | to satisfy the requirements of this subsection. Training |
26 | | regarding the implementation of trauma-informed practices |

1 | | satisfies the requirements of this subsection. |
2 | | (b-25) As used in this subsection: |
3 | | "Domestic violence" means abuse by a family or household |
4 | | member, as "abuse" and "family or household members" are |
5 | | defined in Section 103 of the Illinois Domestic Violence Act |
6 | | of 1986. |
7 | | "Sexual violence" means sexual assault, abuse, or stalking |
8 | | of an adult or minor child proscribed in the Criminal Code of |
9 | | 1961 or in Sections 11-1.20, 11-1.30, 11-1.40, 11-1.50, |
10 | | 11-1.60, 12-7.3, 12-7.4, 12-7.5, 12-12, 12-13, 12-14, 12-14.1, |
11 | | 12-15, and 12-16 of the Criminal Code of 2012, including |
12 | | sexual violence committed by perpetrators who are strangers to |
13 | | the victim and sexual violence committed by perpetrators who |
14 | | are known or related by blood or marriage to the victim. |
15 | | The training regarding domestic and sexual violence and |
16 | | the needs of expectant and parenting youth for staff required |
17 | | by this Section must be conducted by persons with expertise in |
18 | | domestic and sexual violence and the needs of expectant and |
19 | | parenting youth, and shall include, but is not limited to: |
20 | | (1) communicating with and listening to youth victims |
21 | | of domestic or sexual violence and expectant and parenting |
22 | | youth; |
23 | | (2) connecting youth victims of domestic or sexual |
24 | | violence and expectant and parenting youth to appropriate |
25 | | in-school services and other agencies, programs, and |
26 | | services as needed; |

1 | | (3) implementing the school district's policies, |
2 | | procedures, and protocols with regard to such youth, |
3 | | including confidentiality ; at . At a minimum, school |
4 | | personnel must be trained to understand, provide |
5 | | information and referrals, and address issues pertaining |
6 | | to youth who are parents, expectant parents, or victims of |
7 | | domestic or sexual violence; and |
8 | | (4) procedures for responding to incidents of teen |
9 | | dating violence that take place at the school, on school |
10 | | grounds, at school-sponsored activities, or in vehicles |
11 | | used for school-provided transportation as outlined in |
12 | | Section 3.10 of the Critical Health Problems and |
13 | | Comprehensive Health Education Act. |
14 | | (b-30) The training regarding protections and |
15 | | accommodations for students shall include, but is not limited |
16 | | to, instruction on the federal Americans with Disabilities |
17 | | Act, as it pertains to the school environment, and |
18 | | homelessness. Beginning with the 2024-2025 school year, |
19 | | training on homelessness must be completed within 6 months of |
20 | | an employee first being employed by a school board and renewed |
21 | | within 2 years. Beginning with the 2027-2028 school year, the |
22 | | training must be completed within 6 months of the employee |
23 | | first being employed by a school board and renewed at least |
24 | | once every 5 years thereafter. Training on homelessness shall |
25 | | include the following: |
26 | | (1) the definition of homeless children and youths |

1 | | under 42 U.S.C. 11434a; |
2 | | (2) the signs of homelessness and housing insecurity; |
3 | | (3) the rights of students experiencing homelessness |
4 | | under State and federal law; |
5 | | (4) the steps to take when a homeless or |
6 | | housing-insecure student is identified; and |
7 | | (5) the appropriate referral techniques, including the |
8 | | name and contact number of the school or school district |
9 | | homeless liaison. |
10 | | School boards may work with a community-based organization |
11 | | that specializes in working with homeless children and youth |
12 | | to develop and provide the training. |
13 | | (b-35) The training regarding educator ethics and |
14 | | responding to child sexual abuse and grooming behavior shall |
15 | | include, but is not limited to, teacher-student conduct, |
16 | | school employee-student conduct, and evidence-informed |
17 | | training on preventing, recognizing, reporting, and responding |
18 | | to child sexual abuse and grooming as outlined in Section |
19 | | 10-23.13. |
20 | | (b-40) The training regarding effective instruction in |
21 | | violence prevention and conflict resolution required by this |
22 | | Section shall be conducted in accordance with the requirements |
23 | | of Section 27-23.4. |
24 | | (b-45) (c) Beginning July 1, 2024, all nonpublic |
25 | | elementary and secondary school teachers, administrators, and |
26 | | school support personnel shall complete the training set forth |

1 | | in subsection (b-5). Training must be completed within 6 |
2 | | months of first being employed by a nonpublic school and |
3 | | renewed at least once every 5 years, unless required more |

6 | | training from a public school district or nonpublic school |
7 | | employer, the teacher, administrator, or school support |
8 | | personnel may present documentation to the nonpublic school |
9 | | showing current compliance with this subsection to satisfy the |
10 | | requirement of receiving training within 6 months of first |
11 | | being employed. must include the definitions of trauma, |
12 | | trauma-responsive learning environments, and whole child set |
13 | | forth in subsection (b) of Section 3-11 of this Code and |
14 | | (c) (Blank). |

18 | | (g) At least once every 2 years, a school board shall |
19 | | conduct in-service training for all school district employees |
20 | | on the methods to respond to trauma. The training must include |
21 | | instruction on how to respond to an incident involving |
22 | | life-threatening bleeding and, if applicable, how to use a |
23 | | school's trauma kit. A school board may satisfy the training |
24 | | requirements under this subsection by using the training, |
25 | | including online training, available from the American College |
26 | | of Surgeons or any other similar organization. |

1 | | School district employees who are trained to respond to |
2 | | trauma pursuant to this subsection (g) shall be immune from |
3 | | civil liability in the use of a trauma kit unless the action |
4 | | constitutes willful or wanton misconduct. |
5 | | (h) (g) At least once every 2 years, a school board shall |
6 | | conduct in-service training on homelessness for all school |
7 | | personnel. The training shall include: |
8 | | (1) the definition of homeless children and youth |
9 | | under Section 11434a of Title 42 of the United States |
10 | | Code; |
11 | | (2) the signs of homelessness and housing insecurity; |
12 | | (3) the rights of students experiencing homelessness |
13 | | under State and federal law; |
14 | | (4) the steps to take when a homeless or |
15 | | housing-insecure student is identified; and |
16 | | (5) the appropriate referral techniques, including the |
17 | | name and contact number of the school or school district |
18 | | homeless liaison. |
19 | | A school board may work with a community-based |
20 | | organization that specializes in working with homeless |
21 | | children and youth to develop and provide the training. |
22 | | (i) Beginning with the 2024-2025 school year, at least |
23 | | once every 2 years, a school board shall conduct in-service |
