1 | AN ACT concerning behavioral health. | |||||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||||
3 | represented in the General Assembly: | |||||||||||||||||||||
4 | Section 5. The Substance Use Disorder Act is amended by | |||||||||||||||||||||
5 | adding Section 5-28 as follows: | |||||||||||||||||||||
6 | (20 ILCS 301/5-28 new) | |||||||||||||||||||||
7 | Sec. 5-28. Behavioral Health Recovery Center Grant | |||||||||||||||||||||
8 | Program. | |||||||||||||||||||||
9 | (a) As used in this Section: | |||||||||||||||||||||
10 | "Behavioral health recovery center" means a facility that | |||||||||||||||||||||
11 | provides mental health crisis services and substance use | |||||||||||||||||||||
12 | disorder crisis services to individuals who are experiencing a | |||||||||||||||||||||
13 | mental health or substance use crisis that does not require | |||||||||||||||||||||
14 | treatment beyond 23 hours and 59 minutes. | |||||||||||||||||||||
15 | "Project" means a behavioral health recovery center | |||||||||||||||||||||
16 | project. | |||||||||||||||||||||
17 | (b) The Department shall establish a Behavioral Health | |||||||||||||||||||||
18 | Recovery Center Grant Pilot Program in accordance with this | |||||||||||||||||||||
19 | Section. The pilot program shall operate for a 5-year period. | |||||||||||||||||||||
20 | No later than July 1, 2024, the Department shall issue a | |||||||||||||||||||||
21 | request for proposals to award a grant to one or more counties | |||||||||||||||||||||
22 | to develop and implement a behavioral health recovery center | |||||||||||||||||||||
23 | project. A grant awarded under this Section may not be used to |

| |||||||
1 | purchase land for the behavioral health recovery center. The | ||||||
2 | Department shall award all grants under this Section before | ||||||
3 | December 31, 2024. | ||||||
4 | (c) The purpose of a project is to: | ||||||
5 | (1) increase access to mental health crisis services | ||||||
6 | for individuals in the State who are experiencing a mental | ||||||
7 | health crisis or substance use disorder crisis; and | ||||||
8 | (2) reduce the number of individuals in the State who | ||||||
9 | are incarcerated or in a hospital emergency room while | ||||||
10 | experiencing a mental health crisis or substance use | ||||||
11 | disorder crisis. | ||||||
12 | (d) An application for a grant under this Section shall: | ||||||
13 | (1) identify the population to which the behavioral | ||||||
14 | health recovery center will provide mental health crisis | ||||||
15 | and substance use disorder crisis services; | ||||||
16 | (2) identify the type of mental health crisis services | ||||||
17 | or substance use disorder crisis services the behavioral | ||||||
18 | health recovery center will provide; | ||||||
19 | (3) explain how the population described in paragraph | ||||||
20 | (1) will benefit from the provision of mental health | ||||||
21 | crisis or substance use disorder crisis services; | ||||||
22 | (4) provide details regarding: | ||||||
23 | (A) how the proposed project plans to provide | ||||||
24 | mental health crisis and substance use disorder crisis | ||||||
25 | services; | ||||||
26 | (B) how the proposed project will ensure that |

1 | consideration is given to the capacity of the | ||||||
2 | behavioral health recovery center; | ||||||
3 | (C) how the proposed project will ensure timely | ||||||
4 | and effective provision of mental health crisis and | ||||||
5 | substance use disorder crisis services; | ||||||
6 | (D) the cost of the proposed project; | ||||||
7 | (E) any existing or planned contracts or | ||||||
8 | partnerships between the applicant and other | ||||||
9 | individuals or entities to develop and implement the | ||||||
10 | proposed project; | ||||||
11 | (F) any plan to use funding sources in addition to | ||||||
12 | a grant under this Section for the proposed project; | ||||||
13 | (G) the sustainability of the proposed project; | ||||||
14 | and | ||||||
15 | (H) the methods the proposed project will use to: | ||||||
16 | (i) protect the privacy of each individual who | ||||||
17 | receives mental health crisis or substance use | ||||||
18 | disorder crisis services from the behavioral | ||||||
19 | health recovery center; | ||||||
20 | (ii) collect non-identifying data relating to | ||||||
21 | the proposed project; and | ||||||
22 | (iii) provide transparency on the costs and | ||||||
23 | operation of the proposed project; and | ||||||
24 | (5) provide other information requested by the | ||||||
25 | Department to ensure that the proposed project satisfies | ||||||
26 | the criteria described in subsection (f). |

1 | (f) In evaluating an application for the grant, the | ||||||
2 | Department shall consider: | ||||||
3 | (1) the extent to which the proposed project will | ||||||
4 | fulfill the purposes described in subsection (c); | ||||||
5 | (2) the extent to which the population described in | ||||||
6 | paragraph (1) of subsection (d) is likely to benefit from | ||||||
7 | the proposed project; | ||||||
8 | (3) the cost of the proposed project; | ||||||
9 | (4) the extent to which any existing or planned | ||||||
10 | contracts or partnerships between the applicant and other | ||||||
11 | individuals or entities to develop and implement the | ||||||
12 | project, or additional funding sources available to the | ||||||
13 | applicant for the proposed project, are likely to benefit | ||||||
14 | the proposed project; and | ||||||
15 | (5) the viability and innovation of the proposed | ||||||
16 | project. | ||||||
17 | (g) Before June 30, 2025, the Department shall report to | ||||||
18 | the Mental Health and Addiction Committee of the House and the | ||||||
19 | Behavioral and Mental Health Committee of the Senate | ||||||
20 | regarding: | ||||||
21 | (1) each county awarded a grant under this Section; | ||||||
22 | and | ||||||
23 | (2) the details of each project. | ||||||
24 | (h) Before June 30, 2027, the Department shall report to | ||||||
25 | the Mental Health and Addiction Committee of the House and the | ||||||
26 | Behavioral and Mental Health Committee of the Senate, or |

1 | successor committees, regarding: | ||||||
2 | (1) data gathered in relation to each project; | ||||||
3 | (2) knowledge gained relating to the provision of | ||||||
4 | mental health crisis and substance use disorder crisis | ||||||
5 | services in a behavioral health recovery center; | ||||||
6 | (3) recommendations for the future use of mental | ||||||
7 | health crisis services and substance use disorder crisis | ||||||
8 | services in behavioral health recovery centers; and | ||||||
9 | (4) obstacles encountered in the provision of mental | ||||||
10 | health crisis services in a behavioral health recovery | ||||||
11 | center. | ||||||
12 | Section 10. The Illinois Public Aid Code is amended by | ||||||
13 | adding Section 5-52 as follows: | ||||||
14 | (305 ILCS 5/5-52 new) | ||||||
15 | Sec. 5-52. Reimbursement for crisis management services at | ||||||
16 | behavioral health recovery centers. | ||||||
17 | (a) As used in this Section: | ||||||
18 | "Behavioral health recovery center" has the meaning | ||||||
19 | ascribed to that term in Section 5-28 of the Substance Use | ||||||
20 | Disorder Act. | ||||||
21 | "Crisis management services" means behavioral health | ||||||
22 | services provided to an individual who is experiencing a | ||||||
23 | mental health crisis or substance use crisis. | ||||||
24 | "Managed care organization" has the meaning ascribed to |

1 | that term in Section 5-30.1. | ||||||
2 | (b) No later than July 1, 2024, the Department shall apply | ||||||
3 | for a waiver or Title XIX State Plan amendment with the federal | ||||||
4 | Centers for Medicare and Medicaid Services to offer a program | ||||||
5 | that provides reimbursement through a bundled daily rate for | ||||||
6 | crisis management services that are delivered to an individual | ||||||
7 | during the individual's stay at a behavioral health recovery | ||||||
8 | center. | ||||||
9 | (c) If the waiver or Title XIX State Plan amendment | ||||||
10 | described in subsection (b) is approved, the Department shall: | ||||||
11 | (1) implement the program described in subsection (b); | ||||||
12 | and | ||||||
13 | (2) require a managed care organization that contracts | ||||||
14 | with the Department for behavioral health services or | ||||||
15 | integrated health services to provide coverage for crisis | ||||||
16 | management services that are delivered to an individual | ||||||
17 | during the individual's stay at a behavioral health | ||||||
18 | recovery center. | ||||||
19 | (d) The Department may elect to integrate payment for | ||||||
20 | physical health services provided in a behavioral health | ||||||
21 | recovery center. In determining whether to integrate payment | ||||||
22 | under this subsection, the Department shall consult with | ||||||
23 | managed care organizations and counties in the State. | ||||||
24 | Section 99. Effective date. This Act takes effect upon | ||||||
25 | becoming law. |
