AMENDMENT TO SENATE BILL 3617 

2    AMENDMENT NO. ______. Amend Senate Bill 3617, AS AMENDED, 
3with reference to page and line numbers of Senate Amendment 
4No. 1, on page 3, line 6, after "Department.", by inserting 
5"Nothing in this Section shall be interpreted as requiring a 
6financial institution to enter into an agreement with the 
7Department or as requiring a financial institution to change 
8its current practice of cooperating with the Department's 
9requests on a case-by-case basis."; and
 
10on page 3, by replacing lines 8 and 9 with the following:
11"under this Section shall provide that the financial"; and
 
12on page 3, by replacing lines 16 through 23 with the 
13following:, 
14"Department to the financial institution."; and
 
15on page 4, by replacing line 16 with the following:

1"the financial institution's internal procedures."; and
 
2on page 5, immediately below line 16, by inserting the 
3following:
4    "(g) Each agreement under this Section shall provide that 
5the Department shall pay to the financial institution 
6providing or comparing the data a reasonable fee not to exceed 
7the institution's actual cost of providing the data or 
8performing the comparison.".
