SYNOPSIS AS INTRODUCED:

    Amends the Expressway Camera Act. Provides that funds needed to conduct the program for use on expressways under the jurisdiction of the Illinois State Toll Highway Authority may be used for equipment, installation, service, and maintenance of the camera systems, telecommunication costs, and for camera warranties.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Expressway Camera Act is amended by
5changing Section 5 as follows:
 
6    (605 ILCS 140/5)
7    (Section scheduled to be repealed on July 1, 2025)
8    Sec. 5. Camera program.
9    (a) The Illinois State Police, the Illinois Department of
10Transportation, and the Illinois State Toll Highway Authority
11shall work together to conduct a program to increase the
12amount of cameras along (i) expressways and the State highway
13system in the counties of Boone, Bureau, Champaign, Cook,
14DeKalb, DuPage, Grundy, Henry, Kane, Kendall, Lake, LaSalle,
15Macon, Madison, McHenry, Morgan, Peoria, Rock Island,
16Sangamon, St. Clair, Will, and Winnebago and (ii)
17Jean-Baptiste Pointe DuSable Lake Shore Drive in Cook County.
18Within 90 days after June 3, 2022 (the effective date of Public
19Act 102-1042), details about the program objectives, counties
20where the program is operational, and policies under which the
21program operates shall be made publicly available and posted
22online.
23    (b) Images from the cameras may be extracted by any

1authorized user and used by any municipal police department,
2county sheriff's office, State Police officer, or other law
3enforcement agency with jurisdiction in the investigation of
4any offenses involving vehicular hijacking, aggravated
5vehicular hijacking, terrorism, motor vehicle theft, or any
6forcible felony, including, but not limited to, offenses
7involving the use of a firearm; to detect expressway hazards
8and highway conditions; and to facilitate highway safety and
9incident management. Images from the cameras shall not be used
10to enforce petty offenses or offenses not listed in this
11subsection, unless use of the images pertains to expressway or
12highway safety or hazards. Images from the cameras may be used
13by any law enforcement agency conducting an active law
14enforcement investigation. All images from the cameras shall
15be deleted within 120 days, unless the images are relevant to
16an ongoing investigation or pending criminal trial. Cameras
17shall not be used to monitor individuals or groups in a
18discriminatory manner contrary to applicable State or federal
19law.
20    (b-5) By June 30th of each year, the Illinois State
21Police, the Illinois Department of Transportation, and the
22Illinois State Toll Highway Authority shall issue a joint
23report to the General Assembly detailing the program
24operations, including, but not limited to:
25        (1) the cost of installation of cameras by county;
26        (2) the cost of ongoing maintenance of the camera

1    systems per county, including electrical costs and data
2    transfer costs;
3        (3) the number of inquiries where the investigation
4    involved the criminal offenses outlined in subsection (b);
5    and
6        (4) the number of incidents in which law enforcement
7    searched the stored data for the criminal offenses
8    outlined in subsection (b).
9    (c) Subject to appropriation, any funds needed to conduct
10the program for use on the expressways or State highway system
11under the jurisdiction of the Department of Transportation
12shall be taken from the Road Fund and shall be included in
13requests for qualification processes. Any funds needed to
14conduct the program for use on expressways under the
15jurisdiction of the Illinois State Toll Highway Authority
16shall be paid for by funds from the Illinois State Tollway
17Highway Authority and shall be included in requests for
18qualification processes.Funds may be used for equipment,
19installation, service, and maintenance of the camera systems,
20telecommunication costs, and for camera warranties.
21    (c-5) Any forcible felony, gunrunning, or firearms
22trafficking offense, as defined in Section 2-8, 24-3a, or
2324-3b of the Criminal Code of 2012, respectively, committed on
24an expressway monitored by a camera system funded by money
25from the Road Fund and investigated by officers of the
26Illinois State Police may be prosecuted by the Attorney

2committed.
