SYNOPSIS AS INTRODUCED:
 
20 ILCS 1605/7.12

    Amends the Illinois Lottery Law. Provides that the Department of the Lottery's rules shall allow a consumer to redeem all sums of winnings and to withdraw unspent money deposited in the consumer's internet lottery account in the same manner in which it was deposited.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Lottery Law is amended by changing
5Section 7.12 as follows:
 
6    (20 ILCS 1605/7.12)
7    (Section scheduled to be repealed on July 1, 2025)
8    Sec. 7.12. Internet program.
9    (a) The General Assembly finds that:
10        (1) the consumer market in Illinois has changed since
11    the creation of the Illinois State Lottery in 1974;
12        (2) the Internet has become an integral part of
13    everyday life for a significant number of Illinois
14    residents not only in regards to their professional life,
15    but also in regards to personal business and
16    communication; and
17        (3) the current practices of selling lottery tickets
18    does not appeal to the new form of market participants who
19    prefer to make purchases on the Internet at their own
20    convenience.
21    It is the intent of the General Assembly to create an
22Internet program for the sale of lottery tickets to capture
23this new form of market participant.

1    (b) The Department shall create a program that allows an
2individual 18 years of age or older to purchase lottery
3tickets or shares on the Internet without using a Lottery
4retailer with on-line status, as those terms are defined by
5rule. The Department shall restrict the sale of lottery
6tickets on the Internet to transactions initiated and received
7or otherwise made exclusively within the State of Illinois.
8The Department shall adopt rules necessary for the
9administration of this program. These rules shall include,
10among other things, requirements for marketing of the Lottery
11to infrequent players, as well as limitations on the purchases
12that may be made through any one individual's lottery account.
13These rules shall also allow a consumer to redeem all sums of
14winnings and to withdraw unspent money deposited in the
15consumer's internet lottery account in the same manner in
16which it was deposited. The provisions of this Act and the
17rules adopted under this Act shall apply to the sale of lottery
18tickets or shares under this program.
19    The Department is obligated to implement the program set
20forth in this Section and Sections 7.15 and 7.16. The
21Department may offer Lotto, Lucky Day Lotto, Mega Millions,
22Powerball, Pick 3, Pick 4, and other draw games that are
23offered at retail locations through the Internet program. The
24private manager shall obtain the Director's approval before
25providing any draw games. Any draw game tickets that are
26approved for sale by lottery licensees are automatically

1approved for sale through the Internet program. The Department
2shall maintain responsible gaming controls in its policies.
3    The Department shall authorize the private manager to
4implement and administer the program pursuant to the
5management agreement entered into under Section 9.1 and in a
6manner consistent with the provisions of this Section. If a
7private manager has not been selected pursuant to Section 9.1
8at the time the Department is obligated to implement the
9program, then the Department shall not proceed with the
10program until after the selection of the private manager, at
11which time the Department shall authorize the private manager
12to implement and administer the program pursuant to the
13management agreement entered into under Section 9.1 and in a
14manner consistent with the provisions of this Section.
15    Nothing in this Section shall be construed as prohibiting
16the Department from implementing and operating a website
17portal whereby individuals who are 18 years of age or older
18with an Illinois mailing address may apply to purchase lottery
19tickets via subscription. Nothing in this Section shall also
20be construed as prohibiting the Lottery draw game tickets
21authorized for sale through the Internet program under this
22Section from also continuing to be sold at retail locations by
23a lottery licensee pursuant to the Department's rules.

25    (d) This Section is repealed on July 1, 2025.
