Synopsis As Introduced
Proposes to reassign functions among executive branch agencies by transferring all powers, duties, rights, and responsibilities related to the Comprehensive Community-Based Youth Services Program (CCBYS Program) from the Department of Human Services (DHS) to the Department of Children and Family Services (DCFS), effective July 1, 2026, or as soon thereafter as is practicable. Provides for the transfer of (1) DHS staff responsible for work relating to the CCBYS Program; (2) books, records, papers, documents, property (real and personal), and contracts pertaining to the powers, duties, rights, and responsibilities related to the CCBYS Program; and (3) contractual, statutory, or other obligations of DHS relating to the CCBYS Program. Provides that the Executive Order shall not affect the legality of any DHS rules pertaining to the CCBYS Program. Authorizes DCFS to write, amend, or modify any rules, regulations, or other actions, as necessary, to carry out the reorganization. Provides that DHS will operate the CCBYS Program through FY 26 if the CCBYS Program is not transferred to DCFS earlier. Provides that, for FY 27, the DCFS budget request will include General Revenue Fund appropriations for the operation of the CCBYS Program. Specifies that, whenever reports or notices are now required to be made or given or papers or documents furnished or served by any person to or upon the CCBYS Program in connection with any of the functions transferred by the Executive Order, the same shall be made, given, furnished, or served in the same manner to or upon CCBYS Program as part of DCFS. Provides that the Executive Order does not contravene, and shall not be construed to contravene, any contracts, agreements, or collective bargaining agreements. Specifies that the Executive Order supersedes any contrary provision of any other prior Executive Order. Provides for the delivery of a copy of the Executive Order to the Secretary of the Senate and to the Clerk of the House of Representatives. Effective 60 days after its delivery to the General Assembly unless either house disapproves of the Executive Order by the record vote of a majority of the members elected.
