Synopsis As Introduced
Amends the Sexual Assault Incident Procedure Act. Provides that a law enforcement officer shall inform a victim of sexual assault or sexual abuse of the right to request that any interview or statement be conducted in the presence of a law enforcement officer of a particular sex or gender, if one is reasonably available. Provides that if a law enforcement officer of the requested sex or gender is not reasonably available, the interview or statement shall proceed without unnecessary delay.
House Committee Amendment No. 1
Replaces everything after the enacting clause. Amends the Sexual Assault Incident Procedure Act. Provides that a law enforcement officer shall inform a victim of sexual assault or sexual abuse of the right to request to be interviewed by a law enforcement officer of a particular sex or gender. Provides that, if no law enforcement officer of that sex or gender with the training on sexual assault and sexual abuse allegations is reasonably available, the victim may consent to be interviewed by any available law enforcement officer with that training, decline to be interviewed, or choose to schedule an interview when such an officer will be available, if possible. Provides that every law enforcement agency shall establish a policy that defines "reasonably available" for the purposes of the provision. Provides that a law enforcement officer shall inform a victim of sexual assault or sexual abuse of the right to have a support person of the victim's choosing present during any interview by a law enforcement officer or prosecutor, unless the law enforcement officer or prosecutor makes a good faith determination based on professional judgment that the presence of the support person would be detrimental to the purpose of the interview. Provides that, if the support person engages in behavior that disrupts or undermines the interview, the support person may be removed. Provides that, if the support person is not permitted to accompany the victim or is removed, the victim may consent to be interviewed without a support person, decline to be interviewed, or choose to schedule an interview at a later date and bring a different support person.
