Synopsis As Introduced

Amends the Environmental Protection Act. Provides that the Underground Storage Tank Fund shall be accessible by owners and operators who intend to remove underground storage tanks installed over 30 years before removal if the eligibility requirements of specified provisions are satisfied and (1) neither the owner nor the operator is the United States Government; (2) the tank does not contain fuel which is exempt from the Motor Fuel Tax Law; (3) the costs were incurred as a result of removing an underground storage tank installed over 30 years prior to removal; (4) the owner or operator registered the tank and paid all fees in accordance with the statutory and regulatory requirements of the Gasoline Storage Act; (5) the owner or operator notified the Illinois Environmental Protection Agency and the Office of the State Fire Marshal of the owner's or operator's intent to remove the underground storage tank; and (6) the costs have not already been paid to the owner or operator under a private insurance policy, other written agreement, or court order.

House Floor Amendment No. 3

Replaces everything after the enacting clause with the provisions of the introduced bill with the following changes. Replaces references to underground storage tanks over 30 years old with references to underground storage tanks installed before January 1, 1976. Provides that the Underground Storage Tank Fund shall be accessible by owners and operators for eligible costs associated with the removal of underground storage tanks installed before January 1, 1976, including, but not limited to, costs for removal of visibly contaminated fill material within 4 feet of the outside dimensions of the tank, removal of groundwater in the excavation that exhibits a sheen, and sampling to determine whether a release from the tank has occurred (rather than shall be accessible by owners and operators who intend to remove underground storage tanks installed over 30 years before removal). Requires the costs, in order for the owner or operator to access the Fund, to be incurred as a result of removing an underground storage tank installed before January 1, 1976 that contained specified substances (rather than installed over 30 years prior to removal). Requires the owner or operator, in order to access the Fund, to have obtained Agency approval of a tank removal plan and budget prior to the tank's removal (rather than to have registered the tank and paid all fees in accordance with the statutory and regulatory requirements of the Gasoline Storage Act). Deletes a requirement for the owner or operator to have notified the Illinois Environmental Protection Agency and the Office of the State Fire Marshal of the owner's or operator's intent to remove the underground storage tank. Provides that costs paid under a specified provision shall be subject to the application of a $5,000 deductible, and that any deductible amount applied shall also apply towards any deductible amount required under another specified provision so as to prevent the application of duplicate deductibles. In provisions regarding eligibility and deductibility determinations to be made by the Office of the State Fire Marshal, deletes a requirement for the Office to provide a form when an owner or operator notifies the Office of the owner's or operator's intention to remove an underground storage tank over 30 years old. Makes technical and other changes.
