AMENDMENT TO HOUSE BILL 507

AMENDMENT NO. ______. Amend House Bill 507 by replacing everything after the enacting clause with the following:

"Section 5. The Workplace Transparency Act is amended by changing Section 1-35 as follows:

Sec. 1-35. Costs and attorney's fees. An employee, prospective employee, or former employee shall be entitled to reasonable attorney's fees and costs incurred in challenging a contract for violation of this Act upon a final, non-appealable action in favor of the employee, prospective employee, or former employee on the question of the validity and enforceability of the contract.

Sec. 1-35. Compensatory Consequential damages, costs, and attorney's fees. An employee, prospective employee, or former employee shall be entitled to compensatory consequential damages, in addition to reasonable attorney's fees and costs incurred in challenging a contract for violation of this Act upon a final, non-appealable action in favor of the employee, prospective employee, or former employee on the question of the validity and enforceability of the contract or defending an action for breach of a confidentiality agreement pursuant to this Act.

Section 95. No acceleration or delay. Where this Act makes changes in a statute that is represented in this Act by text that is not yet or no longer in effect (for example, a Section represented by multiple versions), the use of that text does not accelerate or delay the taking effect of (i) the changes made by this Act or (ii) provisions derived from any other Public Act.

Section 99. Effective date. This Act takes effect January 1, 2026.".
