AMENDMENT TO HOUSE BILL 616

2    AMENDMENT NO. ______. Amend House Bill 616 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Developmental Disability and Mental
5Disability Services Act is amended by adding Section 8-5 and
6by adding Article VIII as follows:

ARTICLE VIII. ADULT LIVING ARRANGEMENTS

FOR YOUTH IN TRANSITION

 
10    (405 ILCS 80/8-5 new)
11    Sec. 8-5. Transitioning youth; extended services and adult
12living arrangements.
13    (a) Notwithstanding any other provision of law to the
14contrary, the Department of Human Services' Division of
15Developmental Disabilities and the Department of Children and

1Family Services shall adopt rules that permit a licensed child
2care institution (CCI) or children's group home (CGH) that
3provides residential developmental disability services to
4youth under the age of 22 to allow a youth to continue to
5remain in his or her CGH or CCI placement if an independent
6service coordination agency has not secured an adult placement
7for the youth by the youth's 22nd birthday. Such extended
8residential developmental disability services shall be
9reimbursed at the same rate as residential developmental
10disability services provided to youth under the age of 22. A
11licensed CCI or CGH that provides extended residential
12developmental disability services as authorized under this
13subsection shall not be issued any notice of violation or
14citation for providing such services.
15    (b) The Department of Human Services shall establish a
16separate service line to transition youth receiving services
17in a licensed children's residential setting to an adult
18living arrangement that (i) is outside the Home and
19Community-Based Services waiver, (ii) is not a
20community-integrated living arrangement or a State-operated
21developmental center, and (iii) provides the same level of
22support the youth received at his or her previous children's
23residential setting placement.
24    (c) All State agencies that fund children's residential
25services must begin transition planning for adult residential
26placement on or before a youth's 20th birthday.

1    (d) Nothing in this Section shall be construed to reduce
2the level or type of services and supports provided to a youth
3beyond his or her 22nd birthday.".
