| 1 | | Family Services shall adopt rules that permit a licensed child |
| 2 | | care institution (CCI) or children's group home (CGH) that |
| 3 | | provides residential developmental disability services to |
| 4 | | youth under the age of 22 to allow a youth to continue to |
| 5 | | remain in his or her CGH or CCI placement if an independent |
| 6 | | service coordination agency has not secured an adult placement |
| 7 | | for the youth by the youth's 22nd birthday. Such extended |
| 8 | | residential developmental disability services shall be |
| 9 | | reimbursed at the same rate as residential developmental |
| 10 | | disability services provided to youth under the age of 22. A |
| 11 | | licensed CCI or CGH that provides extended residential |
| 12 | | developmental disability services as authorized under this |
| 13 | | subsection shall not be issued any notice of violation or |
| 14 | | citation for providing such services. |
| 15 | | (b) The Department of Human Services shall establish a |
| 16 | | separate service line to transition youth receiving services |
| 17 | | in a licensed children's residential setting to an adult |
| 18 | | living arrangement that (i) is outside the Home and |
| 19 | | Community-Based Services waiver, (ii) is not a |
| 20 | | community-integrated living arrangement or a State-operated |
| 21 | | developmental center, and (iii) provides the same level of |
| 22 | | support the youth received at his or her previous children's |
| 23 | | residential setting placement. |
| 24 | | (c) All State agencies that fund children's residential |
| 25 | | services must begin transition planning for adult residential |
| 26 | | placement on or before a youth's 20th birthday. |
