1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Public Officer Prohibited Activities Act is
5amended by changing Section 2 as follows:
 
6    (50 ILCS 105/2)  (from Ch. 102, par. 2)
7    Sec. 2. No alderperson of any city, or member of the board
8of trustees of any village, during the term of office for which
9he or she is elected, may accept, be appointed to, or hold any
10office by the appointment of the mayor or president of the
11board of trustees, unless the alderperson or board member is
12granted a leave of absence from such office, or unless he or
13she first resigns from the office of alderperson or member of
14the board of trustees, or unless the holding of another office
15is authorized by law. The alderperson or board member may,
16however, serve as a volunteer fireman or as an emergency
17worker and may receive compensation for that service. The
18alderperson may also serve as a commissioner of the Beardstown
19Regional Flood Prevention District board. Any appointment in
20violation of this Section is void. Nothing in this Act shall be
21construed to prohibit an elected municipal official from
22holding elected office in another unit of local government as
23long as there is no contractual relationship between the

1municipality and the other unit of local government. This
2amendatory Act of 1995 is declarative of existing law and is
3not a new enactment.

5    Section 10. The Illinois Municipal Code is amended by
6changing Section 3.1-15-15 as follows:
 
7    (65 ILCS 5/3.1-15-15)  (from Ch. 24, par. 3.1-15-15)
8    Sec. 3.1-15-15. Holding other offices. A mayor, president,
9alderperson, trustee, clerk, or treasurer shall not hold any
10other office under the municipal government during the term of
11that office, except when the officer is granted a leave of
12absence from that office or except as otherwise provided in
13Sections 3.1-10-50, 3.1-35-135, and 8-2-9.1. Moreover, an
14officer may serve as a volunteer fireman or as an emergency
15worker and may receive compensation for that service.
