1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by changing
5Section 3-2007 as follows:
 
6    (55 ILCS 5/3-2007)  (from Ch. 34, par. 3-2007)
7    Sec. 3-2007. Office quarters and hours; violation.
8    (a) The county clerk shall keep the clerk's office at the
9court house of the county, or at such other place as may be
10provided for the clerk by the authorities of such county seat
11and shall keep the office open and attend to the duties
12thereof:
13        (1) (a) In counties of 500,000 or more population from
14    9 a. m. to 5 p. m. of each working day except Saturday
15    afternoons and legal holidays, but the clerk may open the
16    office at 8 a. m. on each working day:
17        (2) (b) In counties of less than 500,000 population
18    from 8 a. m. to 5 p. m. of each working day except
19    Saturdays and legal holidays, but in such counties the
20    office shall remain open until noon the Saturday before
21    general, primary or special election days.
22    Except as otherwise required under subsection (b), all
23county clerk's offices must be closed for all legal holidays.

1The Provided, that the days on which the county clerk's such
2office shall be open and the hours of opening and closing of
3the office of the county clerk, except for any day that is a
4legal holiday, may be changed and otherwise fixed and
5determined by the county board of any county. Any such action
6taken by the county board shall be by an appropriate
7resolution passed at a regular meeting.
8    (b) Notwithstanding any other provision of this Section,
9when any election is held and the results of such election are
10required by law to be returned to the county clerk, the office
11of the county clerk shall remain open for the purpose of
12receiving such results from the time of opening of the polls
13until the returns from each precinct have been received.
14    (c) Any county clerk who fails to keep the clerk's office
15open for the purpose of receiving election returns as required
16by this Section commits a business offense, and shall be fined
17not less than $500 nor more than $5,000.
