AMENDMENT TO HOUSE BILL 690

2    AMENDMENT NO. ______. Amend House Bill 690 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Counties Code is amended by changing
5Section 3-2007 as follows:
 
6    (55 ILCS 5/3-2007)  (from Ch. 34, par. 3-2007)
7    Sec. 3-2007. Office quarters and hours; violation.
8    (a) The county clerk shall keep the clerk's office at the
9court house of the county, or at such other place as may be
10provided for the clerk by the authorities of such county seat
11and shall keep the office open and attend to the duties
12thereof:
13        (1) (a) In counties of 500,000 or more population from
14    9 a. m. to 5 p. m. of each working day except Saturday
15    afternoons and legal holidays, but the clerk may open the
16    office at 8 a. m. on each working day:

1        (2) (b) In counties of less than 500,000 population
2    from 8 a. m. to 5 p. m. of each working day except
3    Saturdays and legal holidays, but in such counties the
4    office shall remain open until noon the Saturday before
5    general, primary or special election days.
6    Except as otherwise required under subsection (b), all
7county clerk's offices must be closed for all legal holidays.
8The Provided, that the days on which the county clerk's such
9office shall be open and the hours of opening and closing of
10the office of the county clerk, except for any day that is a
11legal holiday, may be changed and otherwise fixed and
12determined by the county board of any county. Any such action
13taken by the county board shall be by an appropriate
14resolution passed at a regular meeting.
15    (b) Notwithstanding any other provision of this Section,
16when any election is held and the results of such election are
17required by law to be returned to the county clerk, the office
18of the county clerk shall remain open for the purpose of
19receiving such results from the time of opening of the polls
20until the returns from each precinct have been received.
21    (c) Any county clerk who fails to keep the clerk's office
22open for the purpose of receiving election returns as required
23by this Section commits a business offense, and shall be fined
24not less than $500 nor more than $5,000.
