AMENDMENT TO HOUSE BILL 1346

2    AMENDMENT NO. ______. Amend House Bill 1346 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Police Training Act is amended by
5changing Section 10.22 as follows:
 
6    (50 ILCS 705/10.22)
7    Sec. 10.22. School resource officers.
8    (a) The Board shall develop or approve a course for school
9resource officers as defined in Section 10-20.68 of the School
10Code.
11    (b) The school resource officer course shall be developed
12within one year after January 1, 2019 (the effective date of
13Public Act 100-984) and shall be created in consultation with
14organizations demonstrating expertise and or experience in the
15areas of youth and adolescent developmental issues,
16educational administrative issues, prevention of child abuse

1and exploitation, youth mental health treatment, and juvenile
2advocacy.
3    (c) The Board shall develop a process allowing law
4enforcement agencies to request a waiver of this training
5requirement for any specific individual assigned as a school
6resource officer. Applications for these waivers may be
7submitted by a local law enforcement agency chief
8administrator for any officer whose prior training and
9experience may qualify for a waiver of the training
10requirement of this subsection (c). The Board may issue a
11waiver at its discretion, based solely on the prior training
12and experience of an officer.
13    (d) Upon completion, the employing agency or school
14district shall be issued a certificate attesting to a specific
15officer's completion of the school resource officer training.
16Additionally, a letter of approval shall be issued to the
17employing agency or school district for any officer who is
18approved for a training waiver under this subsection (d).
19    (e) The Board shall develop a process allowing inactive
20law enforcement officers in good standing to participate in
21the course for school resource officers and to be issued
22certificates of completion pursuant to subsection (d). The
23Board may develop any rules necessary to fulfill the
24requirements set forth in this amendatory Act of the 104th
25General Assembly.

2    Section 10. The School Code is amended by adding Section
32-3.06 and by changing Section 10-20.68 as follows:
 
4    (105 ILCS 5/2-3.06 new)
5    Sec. 2-3.06. School Resource Officer Grant Program.
6Subject to appropriation, the State Board of Education shall
7establish the School Resource Officer Grant Program to fund
8salaries and any other costs associated with the hiring of an
9active or inactive law enforcement officer as a school
10resource officer. Eligible entities are schools or school
11districts that have hired an active or inactive law
12enforcement officer as a school resource officer. The State
13Board of Education may adopt rules as needed for the Program's
14implementation and the distribution of grants under this
15Section.

17    Sec. 10-20.68. School resource officer.
18    (a) In this Section, "school resource officer" means an
19active a law enforcement officer who has been primarily
20assigned to a school or school district under an agreement
21with a local law enforcement agency or an inactive law
22enforcement officer who has been hired by a school district
23and who has received a certificate of completion or approved

1waiver issued by the Illinois Law Enforcement Training
2Standards Board under Section 10.22 of the Illinois Police
3Training Act and is able to be hired by the school district.
4    (b) Beginning January 1, 2021, any law enforcement agency
5that provides a school resource officer under this Section
6shall provide to the school district a certificate of
7completion, or approved waiver, issued by the Illinois Law
8Enforcement Training Standards Board under Section 10.22 of
9the Illinois Police Training Act indicating that the subject
10officer has completed the requisite course of instruction in
11the applicable subject areas within one year of assignment, or
12has prior experience and training which satisfies this
13requirement.
14    (c) In an effort to defray the related costs, any law
15enforcement agency that provides a school resource officer
16should apply for grant funding through the federal Community
17Oriented Policing Services grant program.
18    (d) Any school or school district that hires an active or
19inactive law enforcement officer as a school resource officer
20shall be reimbursed for salary and additional costs through
21the School Resource Officer Grant Program established by the
22State Board of Education.
