AMENDMENT TO HOUSE BILL 1355 

2    AMENDMENT NO. ______. Amend House Bill 1355 by replacing 
3everything after the enacting clause with the following:
 
4    "Section 5. The Gasoline Storage Act is amended by adding 
5Section 8 as follows:
 
6    (430 ILCS 15/8 new)
7    Sec. 8. Construction of facilities near school grounds. 
8Beginning on the effective date of this amendatory Act of the 
9104th General Assembly, no person shall construct a new 
10facility with underground storage tanks and associated piping 
11within 300 feet of a public, private, or parochial elementary 
12or secondary school's real property if the facility will 
13engage in the retail sale of motor fuel. This Section is not 
14intended to impact existing facilities or existing underground 
15storage tanks and associated piping, including new or 
16replacement underground storage tanks installed after the

1effective date of this amendatory act of the 104th General 
2Assembly at existing facilities. The Office of the State Fire 
3Marshal shall adopt rules providing for a definition of the 
4term "motor fuel" applicable to this Section in accordance 
5with established definitions of the term and in accordance 
6with the purposes of this Act and this amendatory Act of the 
7104th General Assembly, and may adopt other rules as necessary 
8to implement the provisions of this Section.".
