| 8 | | Beginning on the effective date of this amendatory Act of the |
| 9 | | 104th General Assembly, no person shall construct a new |
| 10 | | facility with underground storage tanks and associated piping |
| 11 | | within 300 feet of a public, private, or parochial elementary |
| 12 | | or secondary school's real property if the facility will |
| 13 | | engage in the retail sale of motor fuel. This Section is not |
| 14 | | intended to impact existing facilities or existing underground |
| 15 | | storage tanks and associated piping, including new or |
| 16 | | replacement underground storage tanks installed after the |
