AMENDMENT TO HOUSE BILL 1461 

2    AMENDMENT NO. ______. Amend House Bill 1461 by replacing 
3everything after the enacting clause with the following:
 
4    "Section 5. Upon the payment of the sum of $1.00 to the 
5State of Illinois, the Director of the Department of Natural 
6Resources is authorized to convey a non-exclusive easement to 
7the KSS Conservation Partners, LLC that is a 20 feet wide 
8ingress-egress easement from public right of way of Banner 
9Dike Road to Senate Island more particularly described as 
10follows:

9    Section 10. The conveyance of the easement authorized by 
10Section 5 shall be made subject to: (1) existing public 
11utilities, existing public roads, and any and all 
12reservations, easements, encumbrances, covenants and 
13restrictions of record; (2) the entering into of a shared 
14maintenance agreement for the land listed in Section 5 that is 
15the subject of the easement between the Department of Natural 
16Resources and KSS Conservation Partners, LLC; and (3) the 
17express condition that if either the Department of Natural 
18Resources or KSS Conservation Partners, LLC ceases to have a 
19shared maintenance agreement for the land that is the subject 
20of the easement in Section 5, said easement shall 
21automatically terminate and the land shall fully revert to the 
22State of Illinois, Department of Natural Resources.
 
23    Section 900. The Director of the Department of Natural 
24Resources shall obtain a certified copy of this Act within 60

1days after the Act becomes law and shall only record the Act in 
2the Recorder's Office of Fulton County, Illinois after the 
3Department of Natural Resources and KSS Conservation Partners, 
4LLC have entered into a shared maintenance agreement as 
5required in Section 10.
 
6    Section 999. Effective date. This Act takes effect upon 
7becoming law.".
