SYNOPSIS AS INTRODUCED:

New Act

Creates the Access to Medically Necessary Vaccinations Act. Provides that any health care provider in this State must provide a vaccination to a patient if: the patient has requested the specific vaccination to be administered; the health care provider has determined that the vaccination is medically necessary; and the health care provider has a stock of one or more doses of the vaccination that have not been reserved for another patient. Prohibits a health care provider from preventing a medically necessary vaccination from being administered to a patient by keeping separate stocks of the vaccination for patients with private insurance and stocks of the vaccination for patients with Medicaid.

A BILL FOR

AN ACT concerning health.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. Short title. This Act may be cited as the Access to Medically Necessary Vaccinations Act.

Section 5. Purpose. The purpose of this Act is to allow patients to receive medically necessary vaccinations while the licensed health care facility retains a stock of the vaccination, regardless of whether the patient has coverage under a private insurance plan or Medicaid.

Section 10. Definitions. As used in this Act:

"Health care provider" means any public or private facility that is licensed to provide, on an inpatient or outpatient basis, preventive, diagnostic, therapeutic, convalescent, rehabilitation, mental health, or intellectual disability services, including general or special hospitals, skilled nursing homes, extended care facilities, intermediate care facilities and mental health centers. "Health care provider" includes any physician or other person that is licensed or otherwise authorized to deliver health care services, including the administration of vaccinations.

"Medically necessary vaccination" means a vaccination that will or is reasonably expected to (1) prevent the onset of an illness, condition, injury, disease, or disability; (2) reduce or ameliorate the physical, mental, or developmental effects of an illness, condition, injury, disease, or disability; or (iii) assist the achievement or maintenance of maximum functional activity in performing daily activities.

"Patient" means any individual who has received or is receiving medical care, treatment, or services from an individual or institution licensed to provide medical care or treatment in this State.

Section 15. Administration of medically necessary vaccinations. A health care provider in this State must provide a vaccination to a patient if:

(1) the patient has requested the specific vaccination to be administered;

(2) the health care provider has determined that the vaccination is a medically necessary vaccination; and

(3) the health care provider has a stock of one or more doses of the vaccination that have not been reserved for another named patient.

Section 20. Prohibition on separate stocks. A health care provider shall not prevent a medically necessary vaccination from being administered to a patient by keeping separate stocks of the vaccination for patients with private insurance and stocks of the vaccination for patients with Medicaid.
