Provides that any health care provider in this State must provide a vaccination to a patient if: the patient has requested the specific vaccination to be administered; the health care provider has determined that the vaccination is medically necessary; and the health care provider has a stock of one or more doses of the vaccination that have not been reserved for another patient. Prohibits a health care provider from preventing a medically necessary vaccination from being administered to a patient by keeping separate stocks of the vaccination for patients with private insurance and stocks of the vaccination for patients with Medicaid. |

| 1 | | AN ACT concerning health. |
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly: |
| 4 | | Section 1. Short title. This Act may be cited as the Access |
| 5 | | to Medically Necessary Vaccinations Act. |
| 6 | | Section 5. Purpose. The purpose of this Act is to allow |
| 7 | | patients to receive medically necessary vaccinations while the |
| 8 | | licensed health care facility retains a stock of the |
| 9 | | vaccination, regardless of whether the patient has coverage |
| 10 | | under a private insurance plan or Medicaid. |
| 11 | | Section 10. Definitions. As used in this Act: |
| 12 | | "Health care provider" means any public or private |
| 13 | | facility that is licensed to provide, on an inpatient or |
| 14 | | outpatient basis, preventive, diagnostic, therapeutic, |
| 15 | | convalescent, rehabilitation, mental health, or intellectual |
| 16 | | disability services, including general or special hospitals, |
| 17 | | skilled nursing homes, extended care facilities, intermediate |
| 18 | | care facilities and mental health centers. "Health care |
| 19 | | provider" includes any physician or other person that is |
| 20 | | licensed or otherwise authorized to deliver health care |
| 21 | | services, including the administration of vaccinations. |
| 22 | | "Medically necessary vaccination" means a vaccination that |
