AMENDMENT TO HOUSE BILL 1763 

2    AMENDMENT NO. ______. Amend House Bill 1763 by replacing 
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the 
5Social Club Member Protection Act.
 
6    Section 5. Definition. As used in this Act, "social club" 
7means a private establishment that is the premises of a formal 
8organization of members for pleasure, recreation, and other 
9purposes. "Social club" does not include a fitness center or a 
10community pool.
 
11    Section 10. Delinquent members. A social club shall not 
12charge a member who is delinquent or in poor standing with the 
13club for the time the member is not allowed in the club or is 
14unable to access the club's services. A contract that violates 
15this Section is void and unenforceable.

1    Section 15. Private right of action. Any person who has 
2been injured by a violation of this Act may maintain an action 
3in the circuit court for damages against any person who 
4committed the violation.
 
5    Section 20. Applicability. This Act applies to all 
6contracts that are entered into, amended, renewed, or extended 
7on or after the effective date of this Act.
 
8    Section 99. Effective date. This Act takes effect upon 
9becoming law.".
