AMENDMENT TO HOUSE BILL 1910

2    AMENDMENT NO. ______. Amend House Bill 1910 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Local Library Act is amended by
5adding Section 1-8 as follows:
 
6    (75 ILCS 5/1-8 new)
7    Sec. 1-8. Opioid antagonists.
8    (a) As used in this Section:
9    "Authorized personnel" means an employee or volunteer of
10the library who has completed training under subsection (d).
11    "Department" means the Department of Human Services.
12    "Library" means a public library established under or
13otherwise subject to the requirements of this Act.
14    "Opioid antagonist" means a drug approved by the federal
15Food and Drug Administration or recommended for use by the
16World Health Organization that, when administered, negates or

1neutralizes in whole or in part the pharmacological effects of
2an opioid in the body. "Opioid antagonist" shall be limited to
3medications approved by the Department for such purpose.
4    (b) All libraries open to the general public in this State
5shall maintain a supply of opioid antagonists in an accessible
6location.
7    (c) Any authorized personnel may administer an opioid
8antagonist to any person whom the authorized personnel
9believes, in good faith, to be having an opioid overdose (i) on
10library grounds, (ii) in the immediate vicinity of the
11library, or (iii) at a library-sponsored event. Authorized
12personnel may carry an opioid antagonist while in the library
13or at a library-sponsored activity.
14    (d) During operating hours, a library shall take
15reasonable steps necessary to have at least one person present
16in the library who has completed training in how to recognize
17and respond to an opioid overdose, including the
18administration of an opioid antagonist. Training may be
19conducted by an organization recognized for providing such
20training or may be created by the library using free resources
21available on the website of the Department or the website of
22the Department of Public Health.
23    (e) A library and its authorized personnel are immune from
24liability for the administration of an opioid antagonist under
25this Section, except that authorized personnel may be liable
26for acts of gross recklessness or acts intended to cause harm.

1Nothing in this Section shall be construed to create a duty to
2act for any authorized personnel.
3    (f) The Director of Human Services may identify
4organizations qualified to offer the training required by
5subsection (d) and may make a list of such organizations
6available on the Department's website.
7    (g) A public library may receive an opioid antagonist from
8any lawful source.".
