AMENDMENT TO HOUSE BILL 2076

2    AMENDMENT NO. ______. Amend House Bill 2076 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Children and Family Services Act is
5amended by adding Section 7.3c as follows:
 
6    (20 ILCS 505/7.3c new)
7    Sec. 7.3c. Vaccination determinations for youth in care.
8    (a) Findings. The General Assembly finds that the
9Department of Children and Family Services should not be given
10priority over parents or foster parents regarding the
11administration of vaccines on youth in care. When the goal is
12family reunification, the Department should not ignore the
13wishes of a parent or other legal guardian on whether to
14vaccinate a youth in care. When the goal is permanent
15placement in a foster home, the Department should not ignore
16the wishes of a foster parent on whether to vaccinate a youth

1in care.
2    (b) Notwithstanding any other rule or law to the contrary,
3the Department shall not approve, authorize, or provide
4consent for the administration of any vaccine on a youth in
5care over the objection of (i) the youth's parent or other
6legal guardian when family reunification is the goal or (ii)
7the youth's foster parent when permanent placement in the
8foster home is the goal. The Department shall adopt any rules
9necessary to implement this Section.
 
10    Section 99. Effective date. This Act takes effect upon
11becoming law.".
