| 2 | | AMENDMENT NO. ______. Amend House Bill 2335, AS AMENDED, |
| 3 | | with reference to page and line numbers of Senate Amendment |
| 4 | | No. 3, by replacing line 20 on page 31 through line 4 on page |
| 5 | | 32 with the following: |
| 6 | | "(b-11) Beginning July 1, 2026, and every fiscal year |
| 7 | | thereafter, if the participant's expenditures in the |
| 8 | | immediately preceding fiscal year are equal to or greater than |
| 9 | | 85% of the amounts appropriated to the participant in the |
| 10 | | immediately preceding fiscal year, then the participant's |
| 11 | | appropriation shall increase by an amount equal to the |
| 12 | | year-over-year percentage increase in revenue deposited into |
| 13 | | the Downstate Public Transportation Fund. Beginning July 1, |
| 14 | | 2032, and every fiscal year thereafter, if the participant's |
| 15 | | expenditures in the immediately preceding fiscal year are |
| 16 | | equal to or greater than 85% of the amounts appropriated to the |
| 17 | | participant in the immediately preceding fiscal year, then the |
| 18 | | participant's appropriation shall increase by an amount equal |

| 1 | | to the year-over-year percentage increase in revenue deposited |
| 2 | | into the Downstate Public Transportation Fund. In no event |
| 3 | | shall the participant's appropriation be less than the |
| 4 | | appropriation for the immediately preceding fiscal year. If |
| 5 | | there was a year-over-year reduction in the revenue deposited |
| 6 | | into the Fund, then each participant's appropriation shall be |
| 7 | | equal to their appropriation from the previous fiscal year |
| 8 | | then each participant's appropriation shall be no more than |
| 9 | | the previous fiscal year's appropriation."; and

| 10 | | on page 138, line 24, by replacing "2029" with "2031 2029"; and
|
| 11 | | on page 155, line 5, by replacing "5" with "3 5"; and
|
| 12 | | on page 163, line 2, by replacing "3" with "5 3"; and
|
| 13 | | on page 264, line 15, after the period, by inserting "Until |
| 14 | | September 1, 2030, the Chair of the Board must be confirmed by |
| 15 | | the Senate. Until September 1, 2030, if the Directors elect a |
| 16 | | Chair of the Board, then the elected Chair of the Board may |
| 17 | | serve as the acting Chair of the Board until confirmation. |
| 18 | | Until September 1, 2030, if the Senate votes against |
| 19 | | confirming the acting Chair of the Board, then the acting |
| 20 | | Chair of the Board must resign and the Directors must elect a |
| 21 | | new Chair of Board.". |
