| 2 | | AMENDMENT NO. ______. Amend House Bill 2337, AS AMENDED, |
| 3 | | in Section 5, Sec. 14-8.02a, by replacing subsec. (g-32) with |
| 4 | | the following: |
| 5 | | "(g-32) A mediation agreement, resolution agreement, or |
| 6 | | settlement agreement may include, as a condition of |
| 7 | | settlement, that a parent, a student who is at least 18 years |
| 8 | | of age or emancipated, the legal guardian of a student, or the |
| 9 | | designated representative of a student who is at least 18 |
| 10 | | years of age prospectively waives a legal right or claim if (i) |
| 11 | | the legal right or claim being waived is related only to the |
| 12 | | student who is the subject of the mediation, resolution |
| 13 | | meeting, or settlement negotiations, (ii) the legal right or |
| 14 | | claim being waived is related to the claims raised in the |
| 15 | | complaint being settled, and (iii) the prospective waiver is |
| 16 | | for a reasonable duration not to exceed the duration of the |
| 17 | | mediation agreement, resolution agreement, or settlement |
| 18 | | agreement.". |
